Research On Competitive Clauses In Regional Free Trade Agreement

After the negative integration stage gradually moving towards the positive integration stage,the international community began to focus on the competition issues.In the Doha Round negotiations about multilateral international competition issues is blocked,regional trading agreements become the main place for the international competition negotiations.Recently in many regional trading agreements it was already stipulated competition clauses with special chapter.This article by studying the contents and characters of the current regional free trading agreements competition terms,analysing the characteristics and the theoretical basis of various patterns.Hopefully,this article can provide some positive and useful suggestions on text setting of competitive terms for our country in the future.First of all,this article introduces the meaning and historical evolution of the regional free trade agreement competition clauses,including the discussion of the concept and the value of the competition clauses,and then extends to the concept of competition clause in the regional free trade agreement,we realized that the competition clauses in the region free trade agreements is becoming more and more important.Secondly,it analyzes the three models of the current regional free trade agreement competition clauses,introduces the characteristics of these three models of competition clauses,especially the TPP model,which is the latest development of the competition clauses.The TPP model is very important in this article,through the study of this model,it will bring a lot of suggestions for the China's regional free trade agreement about competition clauses.After the introduction of the model,it is found that the content of each type of competition clauses is different,some focus on the substantive provisions and some of the procedural provisions,so this article analyzes the content of current regional free trade agreement of competition clauses,then it will provide many suggestions to our country competition clause.Finally,after analyzed the current situation and existing problems of China'sregional free trade agreement.we list the stipulations of our country's free trade agreement on the competition clauses,So we can be more intuitive to analyze the problem of our country's competition clauses,and then formulate the text of our country.
