The Research Of Legalization Of Major Administrative Decision-making Of Local Government

In recent years,the local level legislation and normative documents related to major administrative decision-making emerge in an endless stream.The research for legalization of major administrative decision-making is also continuing without end.In the goal of building a moderately prosperous society and deepen the reform and opening up in 18 th National Party Congress report mentioned that objective of the struggle to achieve the goal of “the rule of law should be fully implemented as a basic strategy,a law-based government should be basically in function” in 2020.For the first time,the rule of law is basically built into the strategy of governing the country according to law.Then the decision of 4th plenary session of 18 th CPC Central Committee mentioned that we must improve law-based decision-making mechanisms;include public participation,expert evaluation,risk assessment,legality review,and collective discussion and decision making into the legal procedures for making major administrative decisions.Thus,the legalization of local government major administrative decision-making is around the corner.The research on this topic plays an important role in perfecting the system of local government decision-making mechanism and has a positive meaning on the timely introduction of major administrative decision-making in the field of legislation.This article is divided into five chapters except the introduction part:The first chapter is about the basic theory of the major administrative decision-making of the local government.In this chapter,it introduces the concepts of major administrative decision-making,and the rule of law.The second chapter focuses on the analysis of the necessity of the rule of law in the local government to realize the rule of law in our country,which is from the national policy,economic,social and other aspects.The third chapter is about the development of China's local government legalization of major administrative decision-making,through examples and compare the way respectively from the two aspects of central and local governments are discussed.The fourth chapter on the basis of the above,the existence of our current local government legalization of major administrative decision-making problems in the process are summarized,the main problems have been deeply analyzed.In the fifth chapter,based on the issues raised in the fourth chapter,on China's local government legalization of major administrative decision-making is the conception,which is the innovation of this paper.First,define local government major administrative decision-making subject,scope of matters;then,the emphasis is placed on the major administrative decision-making procedures,respectively,from public participation,expert argumentation,risk assessment,review of administrative legality,collective discussion decided five aspects of local government major administrative decision-making rule of law concept;finally,from accountability system,such as the head of the system,lifelong chase accountability,responsibility investigation mechanism,the perfection of the structure of the conception of the major administrative decisions of the local government.Major administrative decision-making has a close relationship to the interests of administrative counterpart.The merits and demerits of major administrative decision-making of local government directly affect the quality of administrative decision-making.Today the process of legalization of China is pushing forward continuously.The scientific,democratization and legalization of major administrative decision-making process of local government will be particularly important and urgent.It must formulate the main body of decision-making right and responsibility clearly.The system such as public participation,expert evaluation and risk assessment will be with strict requirements.We should improve and perfect the mechanism of decision-making in accordance with law,strictly follow the statutory procedures of major administrative decision-making,make efforts to control the risk of decision-making and effectively improve the quality of major decision-making of local government.
