Research On System Of Intellectual Property Protection For Graphical User Interface

Graphical user interface(GUI)assumes the important role of human-computer interaction,from the early simple words,tables,form and combination of these,developing to the current status,which including operation convenience,concise and beautiful,strong affinity,ease of use higher characteristic.Currently,the GUI becomes the most prominent type of user interface and occupies the central position of the current age of the Internet.Meanwhile,the proportion of creative labor in the research and development activities on the GUI is deepening,and the GUI which includes computer science,design science,aesthetics,behavioral science,psychology and other multi-disciplinary content becomes to be creative product.Under the impetus of the industrial economy,the protection of the GUI which is included by trademark law and anti-unfair competition law early and then is included by copyright law later turns into protection of patent currently.Present research on the intellectual property protection(IPR)of the GUI mostly appear to be researches and arguments on a specific right.Meanwhile,there are two kinds of typical views which are traditional copyright and rising patent right opposite each other.Under this background,the author thinks the GUI includes multiple attribute,such as artistry,technicality,aesthetics,practical,identification,operational etc,which is a typical object concentrating multiple “intellectual property”.And then,the author argues that the GUI is an object which is not protecting by only one IP right,but protecting by multiple IP rights.Based on different adjustments aims,different rights provide different kinds of protection.In this paper,the IPR of the GUI is regarded as a overall system.On the basis of clearing each mode of IP protection and the multiple IP property of GUI,we discuss multiple protection of GUI.According our country's development,we consider the structure and relationship of each protection mode and establish a system from multidimensional IP protection.In this system,copyright is the foundation,patent right is the kernel and trademark law and anti-unfair competition law is additional.This system combine multiple IP rights.We pursue to build up a wonderful IP protection system of GUI.
