Economic globalization,the international investment has become the engine driving the global economy development.Since China's accession to the WTO,the scale of foreign investment of real estate industry in our country,on the whole,shows the rising trend of twists and turns.According to the Ministry of Commerce ‘ foreign investment report of China in 2013'statistical data,the number of foreign direct investment projects in 2012 is25000,the amount of actual use of foreign investment is $111.72 billion.A large number of foreign capital was invested into real estate industry,the development of the real estate industry of our country there are both positive effects and negative effects,both promoted the overall level of China's real estate industry and the level,in line with international standards and accelerate its speed,advancing steps to enter the international market;Also sped up the prices,contributed to the formation of the real estate market bubble,to a certain extent,caused the property market overheating and triggered a series of problems,and caused a certain negative effects for the country's economic security and social stability.The effective legal regulation of foreign investment of real estate industry is an urgent task.This article starts from the overview for the development course of foreign investment in real estate industry.Summing up the present situation of legal regulation for foreign investment in real estate industry based on the analysis of the form ? characteristics and influences on it,putting forward some existing problems on the legal regulation of foreign investment in real estate industry at present in our country,and,in turn,Putting forward some suggestions to perfect legal regulation of foreign investment in real estate industry.In this paper,the specific structure is as follows:The first chapter mainly summarizes the foreign investment in real estate industry.Through the development of foreign investment in real estate industry in China,discusses the form,summarizes characteristics,and analysis its positive and negative effects.The second chapter mainly discusses the present situation of legal regulation for foreign investment in real estate industry,firstly sums up the foreign investment in real estate industry relevant files,then combs to regulate content of legal system of foreign investment in real estate industry,at last summarizes the characteristics of the legal regulation for foreigninvestment in real estate industry.The third chapter mainly analyses the existing problems on legal regulation of foreign investment in real estate industry in our country.From the legislation system,direct regulations,auxiliary regulations three aspects,points out the existing problems on it.The fourth chapter mainly puts forward the perfection for the legal regulation of foreign investment in real estate industry: formulate unified law for foreign investment in real estate,perfect the relevant legal policy of foreign exchange,the policy to improve the related tax laws are proposed.
