The Research On Notification Of Medical Treatment

Objective:According to section 55 of the Tort Liability Law promulgated in 2009,medical workers should make sure the patients are aware of the state of an illness and the medical practice in the clinical activities.If the medical workers fail to fulfill the duty to inform,thus causing damage of patients,medical institutions shall bear the responsibility for compensation.But from all those medical disputes,it can be seen that the notification of medical treatment still faces many difficulties.This research will further expand on the research on notification of medical treatment and doctor-patient communication,focus on "increased doctor-patient communication,improve the doctor-patient relationship,security knowledge,improve the quality of medical treatment",explore in the face of many plights,come up with some strategies suitable for China's national conditions at the same time.Methods: The methods of literature research and case analysis has been adopted.through databases such as China National Knowledge Infrastructure,Wanfang,VIP,Pubmed,Medline,Duxiu,Chaoxing,baidu,ect,The author have widely collected documents regarding doctor-patient relationship,doctor-patient communication,notification of medical treatment and informed consent from academic papers,works and books,reports,newspapers,and legal documents.By elaborating the components of notification as well as its theoretical requirements,This thesis has analyzed the plights of notification from three different angles,namely,the subject,the object,and the law in medical inform.Results:The nuremberg code was enacted in 1946 for the first time put forward the concept of "informed consent".Since then,countries around the world have established the "Theory of Informed Consent".In 1981,the World Medical Association issued the Declaration of Lisbon on the Rights of the Patients,stating that the patients enjoy 11 rights including the right of informed consent.Notification include two categories:notification of medical experiment and notification of clinical treatment,this research mainly refers to the clinical treatment.Legal documents on informed consent appeared as early as 1951 in our country.But at present,it is still facing problems: lack of humanistic education,failure of doctor-patient communication,the advantages and disadvantages of familism,the accuracy in assessing patients' capability of informed and imperfect laws and regulations,etc.Conclusion:Medical workers must carry out the obligations of informing.Doctor-patient communication is the essence of notification.Facing the problems,the government should allot health resources rational,increase the proportion of government health cost,play a role of the "gatekeeper";Clearing the agency system,the agent must provide proof of the law and patient relationship,the agent of medical decisions must ensure that the interests of the patients;Regulating the informed consent form,in this study,the author design in general surgery "laparoscopic gallbladder excision surgery(LC)informed consent form" and embody the patient's subjective initiative;Humanistic informed:improving environment,choosing a correct time and empathizing the patients.Finally,from the perspective of laws and regulations regulating medical system.
