In recent years,China has continuously increased anti-corruption efforts to crack down on corruption,corruption and corruption has become a fight against corruption in a difficult,a large number of flight corrupt officials not only swept away a large number of illegal wealth,to the country and the people cause huge Of economic losses,but also let the anti-corruption work in trouble,challenging the legal authority.If the corrupt officials can not be brought to justice,then the people will lose confidence in the law,so the corrupt extradition to return to the country to accept the legal sanctions without delay.Extradition is an important measure of criminal judicial cooperation between countries and an important guarantee for safeguarding the judicial sovereignty of the country and punishing corrupt officials.Since the adoption of the Extradition Law of the People's Republic of China in 2000,after more than 10 years of improvement,China has formed an extradition legal system composed of domestic legislation,international conventions and bilateral treaties.However,the number of extradition treaties and agreements between China and the developed countries is very small.Moreover,since the introduction of the United Nations Convention against Corruption in recent years,there have been many new developments in international extradition law.The extradition procedure is more complicated,the protection of human rights in extradition is lacking,can not adapt to the new trend of international extradition,and all of them become the obstacle to the extradition of corrupt officials.Therefore,this article intends to analyze the problems of extradition of corrupt officials in China by analyzing the Convention and comparing the extradition laws in China and abroad,thus providing a theoretical reference for the perfection of our corrupt officials' extradition system.
