The Study On The High Degree Of Autonomy Of The Special Administrative Region Of The People's Republic Of China

The high degree of autonomy is the core of the special administrative region system,which is a new type of local autonomy under the guidance of the theory of "one country,two systems".After the return of Hong Kong and Macao,the practice has proved that the high degree of autonomy of the special administrative region is an important guarantee for the realization of national unity,the maintenance of the authority of the central authorities and the guarantee of the prosperity and stability of Hong Kong and macao.But the system and culture in two distinct coexist in the same country,is a splendid history of pioneering work,is a serious challenge: since the return of Hong Kong and Macau,although a high degree of autonomy in running well on the whole,but the administrative power,legislative power and judicial power there are some serious problems in operation,such as the issue of universal suffrage,dual problems,national security legislation interpretation of the basic law conflicts and other issues,we need to perfect the guarantee for the healthy development of a high degree of autonomy.Start from the general theory of autonomy,discussed the concept of a high degree of autonomy,the characteristics,basic contents,protection and supervision mechanism,then compared by a high degree of autonomy and other local autonomy,highlighting the autonomy characteristic.On this basis,this paper analyzes the problems existing in the operation of a high degree of autonomy,and finally puts forward some suggestions for the problems in the operation of the high degree of autonomy.This paper argues that the improvement of a high degree of autonomy,in respect of the reality on the basis of the constitution,in the framework of the basic law,in one country two systems under the guidance of the principle,put forward the suggestions,the only way to ensure a high degree of autonomy,effective operation and healthy development in the system of special administrative region.The article is divided into five parts.The first part expounds the general theory of a high degree of autonomy,the autonomy of the general principle,a high degree of autonomy,the concept and characteristics of a high degree of autonomy,the basic content and a high degreeof autonomy,the theoretical basis in detail.The second part mainly study the high degree of autonomy,is mainly through a high degree of autonomy to a high degree of autonomy and foreign local autonomy,autonomy and national regional autonomy and the Hongkong and Macao special administrative regions,to reflect the high degree of autonomy is a new type of local autonomy,with the characteristics of high degree and range.In the third part,the author discusses the guarantee and supervision mechanism of the high degree of autonomy,in order to highlight the high degree of autonomy is the power of the central government and the basic law,as well as the central authority to enjoy a high degree of autonomy.The fourth part mainly analyzes the problems in the operation of the high degree of autonomy,and expounds the problems existing in the operation of administrative power,legislative power and judicial power.In the fifth part,the author expounds the perfection of the high degree of autonomy.In view of the problems existing in the operation of the high degree of autonomy,the paper puts forward some suggestions for improvement.
