Judge post system reform involves not only the allocation of the internal staff of the court,but also related to the construction of supporting systems,which will affect the operation of the court.The implementation of judicial system reform,standardizing the judge selection criteria,improve the overall quality of the judges,to meet the requirements of the construction of a team of judges of the occupation and modern times;after the reform of personnel allocation is more reasonable to improve trial quality,enhance the credibility of the judiciary;the court system will improve efficiency,saving the cost of justice;to promote the necessary process post system reform is the implementation of judicial modernization.China's judicial reform pilot implementation way in the batch build pilot,pilot work smoothly,has achieved initial results: court personnel structure more reasonable;trial efficiency is greatly improved;the management mode of the change to the administrative court is gradually advancing.These pilot system for the reform of the judges accumulated experience,provide a reference.The system of judge posts has reformed the original court system,but many new problems have emerged.Reform should be reasonable,but China has no laws to provide strong support to promote the personnel system reform.The proportion of the pilot to the court of the provisions of the parties,but the judge how to determine the proportion of the standard is not uniform,the weight of various factors is not clearly defined.The implementation of the judge's request to streamline the ranks of judges,but the social situation is increasing in the case,the reform process in the case of more than a small number of contradictions intensified.Are judges reform means that someone in the amount of people have been eliminated,there are differences in the standard pilot local judge selection set,how to ensure the outstanding talent to stay in the team of judges,judge selection and elimination standards need to be improved.Post system after the reform of the trial judge to judge the increase of pressure,from the complicated affairs,equipped with auxiliary personnel more is needed,but the judge assistant system is not perfect,not to play its due role in assisting the judge.In the face of the problems existing in the reform of the system of judges' posts,this paper puts forward the relevant reform ideas on the basis of the national policy of judicial reform and the practical experience of various countries.From the top-level design and practice around the establishment of standards to determine the reasonable judge posts,the judges of the selection,assessment,and the establishment of a fair and reasonable standards,so that qualified personnel fair competition.Reform of the country has been given the court internal personnel proportion,but the proportion of this division is general,in which the actual reform still needs to be further optimized,the different types of personal responsibilities are clearly defined.The court of the relevant system group to proceed or to go ahead in the post system reform,establish the individual job sequence,strengthen the judge's occupation guarantee;build a high-quality judicial support staff,improve the judicial efficiency;establish cases triage system,the transformation of the summary procedure in our country,the existing small program;To create a diversified dispute resolution mechanism to alleviate the contradiction between the more case and a few people.
