Degree system is originally a medieval European guild teaching qualification certificate, then gradually become the important scale of Middle Ages and talents of higher education evaluation in Western countries. In ancient China, there was no degree system in the strict sense, but the imperial examination system was the main tool for the selection of talents.The modern significance of the academic degree system in our country is to introduce western degree system. 1980 "People’s Republic of Ancient Chinese Literature Search bit regulations" after the enactment of the degree system in our country has achieved great development, but also exposed many problems, the revised "the People’s Republic of Ancient Chinese Literature Search Ordinance" or "law" has been promulgated in imminent.In this paper, four typical degree dispute case as the object, put forward the "degree rule" problems, the problems existing in the analysis of the reasons for "Degree Regulations", summarizes the developed countries for reference on the experience of related degree, with academic autonomy as a means to human development as the ultimate objective, puts forward some basic ideas and Countermeasures for constructing the legislative system in China’s degree. Besides the introduction, the text is divided into five parts:The first part of the questions through the analysis of classic case. Including the case Liu Yanwen v. Peking University case, Chu Yue v. Tianjin Normal University case, Zhang Fuhua v. Putian University case and Northwest University of Politics and Law to apply for doctoral degree case. The case of disputes or common, or solely reflects: "degree rule" of administrative rights is unknown, granting conditions is fuzzy, the audit of degree authorization is not standardized, and lack of exercise of the right degree of due process and other issues.The second part is on the basis of the development of the theory of academic freedom and the review of the history of the development of the comparative degree, degree and degree granting the right concept, related theory of degree system, this paper defines the concept of degree, laid the theoretical foundation for this study.The third part is the introduction and reference of foreign countries in legislative experience. The common law of the United States and Britain, continental law, German comparative study, summarizes the experience for reference, for our country’s legislation established a standard of comparison.The fourth part is the analysis of the causes of problems. That lack of academic freedom, bound education centralization system, coupled with the "Degree Regulations" have changed, do not meet the requirements of the times is the main cause of the problems in the system.The fifth part is the construction of the system. The basic concept of clear degree, straighten out the subject degree in the management system of rights and obligations, to achieve the degree authorization audit law, granting conditions set scientific, perfect the mechanism of supervision and relief activities in other aspects, put forward our country’s legislative system frame.
