Research On The Systems Of Putting Forward And Reviewing Of Legislative Bill Of The Deputy To The National People's Congress

The deputies of the NPC is selected by the mass and through the NPC they are on the behalf and maximize the interest of the mass, and putting forward legislative bill is one of their measures. Right of making motions of the deputies of the NPC is the middle way for the mass to perform the state power, reflecting the principle of popular sovereignty. This system also is helpful to give full play to the resumption of deputies of the NPC according to law and the mass' s intelligence and wisdom, enhance the construction of democracy and law, and promote the pace of law-based governance. However, so far there are still many problems in the system of legislative bill, like problems in the way of putting forward a legislative bill, problems in the deliberation subject and deliberation process as well as the low quality of the bill and the absence of the legislative hearing system. Putting forward a legislative bill is the very beginning of the official legislative procedure, is conclusive to make clear that which problems can be listed in the legislatorials agenda. To some extent, it also decide which behaviors should be restricted by the law and play an important role in the process of law-based governance. Hence, the legislative bill system should be improved. This paper mainly studies the National People's Congress legislation system, in which the proposed legislation and legislation review stage. Analysis in two stages of the status quo, existing problems, reasons and countermeasuresThis thesis, except the Introduction part, is composed by the below five parts:In Part One, this thesis firstly makes a contrastive analysis on the concept, proposal, rogation as well as the legislative advice and suggestion of the bill of deputy to the National People's Congress and defines the concept of this bill. Secondly, this thesis discusses the nature of this bill, defines the dual attributes of the bill, put forward the theoretical support of legal remedy for the bill in case of infringement. Thirdly, this thesis will discuss the importance of the system of the bill. In addition, in this part also analyzes the bill to the National People's Congress system development process.Part two is about the propose system of the bill. This part will analyze(1) the presidium of the NPC or 30 of the deputies of the NPC jointly put forward a legislative bill, resulting in waste of legislative resource and low legislative efficiency;(2) the low quality of some of the deputies of the NPC and the not cloth contact between them and the mass result in the low quality of the legislative bill which need to be improved.Part Three is about the review mechanism of the bill, which includes four stages,(1) National People's Congress on behalf of the proposed legislation to suffer unfair treatment.(2) Provision of the hearing system review procedure.(3) People's congress legislation is difficult to include in the review meeting.(4) The review results without relief wayThe fourth part analysis the National People's Congress proposed legislation in the cause of the problem and review stage. This paper mainly analyses the reason of the following three aspects: First, the legislation of our country pursues the dominant ideas. Second, in the pursuit of efficiency and quality of planning legislation Third, the National People's Congress on behalf of their own problemsPart Five is about the suggestion on the system of the bill, including(1) change the state-steering legislation concept and reform the legislative project;(2) Reforming the legislative plan of blindly pursuing efficiency and quantity;(3) Promotion of the National People's Congress on behalf of the role and quality(4) Strengthening representative to represent the unit started their support;(5) reinforce the relief for the right of making motions of the presidium of the NPC and complete the legislation bill system.
