Empirical Study Report On Publicy Of Prosecusial Legal Files No-line In G Province

The publicity of procuratorial work contains the specific prosecution procedures and criminal cases details.To disclosure the procuratorial files to specific or unknown public objects is one of the most effective way to accomplish the goal that they will be supervised by other social objects.Such opening policy is also one of the most important way to fulfill “strengthen judicial opening” policy which has been presented in The Decision on Major Issues Concerning Comprehensively Deepening Reforms.Nowadays,disclosure criminal case-related procuratorial files on-line holds the advantage of being more convenient and less time-consuming than other ways.Besides,such way also broadens the impact of these procuratorial files,improves their effectiveness,maintains criminal judicial justice,improves the credibility of prosecutors,strengthens the consistence of sentence and flourishes criminal law related research.In all,to disclosureprocuratoriallegal filesholds great means for criminal justice in practice.Recently,People's Procuratorate of G Autonomous Region hasissued several official documents to explore how to uncover the procuratorial legal documents and gained full experience.Right now,this study aims at investigating the practical way to disclosure procuratorialworks to public empirically and carding the scope,approaches,procedures,facts,problems,and reasons referring to disclosure procuratorial fileson the base of related theoretical and instrumental research.At last,this study also intended to propose several suggestions and implications to improve the publicity of procuratorial work,so that the value of the publicity of procuratorial workwill be exaggerated to the maxim.In this study,there are four parts,including 18000 words in total.Part 1 describes the specific practices on the disclosure of legal files referring prosecution.To improve the disclosure of prosecution legal files is to ensure the right to information for public citizens.In addition,it also means a lot for improving the management of prosecution work in practice.Since Otc.1998,the Supreme People's Procuratorate had passed through “ten rules for the publicity of procuratorial work”,and then broadened it to 13 rules..hese rules ensure that the publicity of procuratorial work is the priority for the Basic level people's procuratorate.In 2004,the Supreme People's Procuratorate nominated the pilot work of the publicity of procuratorial work as one of the four revolutionary work,including the publicity of procuratorial work on-line.In 2015,every semi-Supreme People's Procuratorate documented thatthe publicity of procuratorial work on-line should head to be standardized and normalized.Part 2 is the empirical analysis of the fact and achievements of the publicity of procuratorial work on-line.From Jun.2014,the People's Procuratorate of G Autonomous Region took several approaches to implement and operate the publicity of procuratorial work,including indictment,denied application for supervision,ect.All these work showed a big progress in the publicity of procuratorial work.From 2015 to Jun.2016,all the people's procuratorate issued 32941 legal files,about 63% closed cases,ranked at 17 th in China.They all made significant progress on cleaning the way for public information,being supervised by public,improving the transparency of prosecution work,correcting the ways of public service and improve the credibility of people's procuratorate work.Part 3 discussed the problems referring the publicity of procuratorial work.In current,some People's Procuratorate have the problem in the publicity of procuratorial work,including disclosuringprocuratorial legal files behind time,uncovering un-normalized legal files,using un-professional technological ways,unblocking ways to feedbacks from pubic citizens,and un-balancing work development.All these problems have effects on putting forward ofthe publicity of procuratorial workeffectively.Part 4 proposed several suggestions to improve the Publicity of Procuratorial Work.First of all,the principles of the Publicity of Procuratorial Work should be clarified further.Second,the scope of the Publicity of Procuratorial Work should be correctly defined.Third,the approaches for the Publicity of Procuratorial Work should be furtherly broadened.Forth,the procedures of the Publicity of Procuratorial Work need to be perfected.The last but not the least,related mechanism to guarantee the citizens' suggestions be fully reviewed should be set up.
