On Perfecting Legal System Of Photovoltaic Power Generation Industry In China

Energy,the country's most important strategic public product,is the driving force of economic development.Faced up with challenges from aspects of social progress,environmental pollution,climate change and fossil energy exhausting,renewable energy represented by solar energy plays a more and more important role in the national energy strategy system..it will inevitably become the focus of China's renewable energy development and utilization.As well as the speciality of this industry itself and the intendency of dependence on policy raise many problems,this area is facing so many disadvantages such as high production cost,the unstable market,and the variable development environment.At present,the photovoltaic industry is in a transition stage in our country,bearing many problems of the profit distribution.Chaos in the reality indicates that industrial structure adjustment can't only rely on the policy,but inevitably it needs to turn the logic of the law--to make experience of system concrete.Those problems expose the imperfection in legislation and policy of renewable energy law system dominated by the currenting Renewable Energy Law.The problems also reflected the relevant legal protection system,the economic incentive system and supervision system are not so mature that they can't support to ensure the orderly development of photovoltaic industry.Only through regulating the legal system,to make the system go throughout each link of the production,supply,distribution,and consumption through the fair and rational concept of law itself,and to emphasize the legal form's supportive function,can the development of photovoltaic industry be deepened.Industry development problem has always been extremely important.This article first looks directly at the problems exposed in the process of development of the photovoltaic industry,analyses those ones being widespread in rhis area and most needed to be solved,and introduces the the support of law and ensurance needed for the industry's benign development.Then this paper summarizes the laws regulations and policy legislation related to the photovoltaic industry,and interprets them by means of specific legal system,and finds the problems existing in the implementation through the analysis of the legislation and practice.Finally,it gives advice aiming at suggestions for perfecting the relevant legal system in the development of industry,helps to build the government guide,market mechanism and legal system,the system of the organic combination of structure,to continue to implement the laws and regulations conforming to the industrial development direction and work.It also pays attention to combining with the industry present situation to adjust and perfect the concrete system,and to forming the legal system which is beneficial to the development of photovoltaic industry in China.The writer hopes that by observation of policy and law,this paper can provide more reference for the healthy and orderly development of photovoltaic industry in the future.
