Research On The Legal Issues Of Refugee Identification

With the increasing attention received,it has become the most fundamental issue that how to define a refugee,or which can be refugees who can enjoy the rights of refugees in the country throughout the world system.Over the international law view,this paper starts with the two main legal documents about refugees: <Convention Relating to the Status of Refugees> and <Convention and Protocol Relating to the Status of Refugees>,supplemented by the main countries in Europe and America on the refugee law,trying to explore the existing refugee law in the legal issues.In addition to the introduction,this paper is divided into parts: the substantive conditions of refugee identification,the legal issues in the process of refugee identification.The first chapter is an overview of refugee issues.Mainly,it describes the development of refugees,the types of refugees,and the significance of refugee identification.The second chapter is about the condition of refugee status,which mainly analyzes the identification,elimination and termination of refugee status.The chapter focuses on the main ways of international organizations and typical countries.Importantly,based on the exception of identification of refugee status,it also analyzes the shortcomings of the refugee status in the substantial program,and puts forward some suggestions to solve the problem.In the third chapter,the author analyzes the problem of the procedural law.It mainly make analysis in the UNHCR and typical countries,by the way,also analyses the role of the principle of non-refusement of refugee in determining the refugee identification procedure,and puts forward some legal proposals to solve the problem of refugee identification.The fourth chapter is about the legal improvement of refugee status in China.Combing the status quo existing,drawing on the existing international refugee law,it puts forward terms substantial and procedural conditions of Chinese refugee identity.The paper advocates the establishment and improvement of China's refugee law system,the implementation details of the Refugee Law and other laws and regulations,in order to deal with the increasingly prominent refugee problem do a good legal support.
