The Legalizing Of Central-Local Relationship In The Scope Of Local Autonomy

The relationship between the central and local is a fundamental issue, which is related to political construction, economic construction, social construction of one country. And local autonomy is an important research direction in the relationship between the central and local. In the practice of local autonomy, how can we guarantee the decentralization between the central and local be rational, scientific and efficient, and how to prevent excessive centralization and excessive decentralization is a very important point that we should pay attention to. From the legal point of view, assisting and promoting the legalizing of the central-local relationship would play a positive role in solving this problem.This article mainly consists of three parts, analyzes the issues of legalizing the relationship between the central and local power systematically. Firstly, we discuss about the central and local legal relations, especially about the central-local relationship in the scope of jurisprudence. This is the key to discuss the legal relationship between the central and local power and it lays the foundation for the study of the legalizing of the central-local relationship. Secondly, we explore the relationship between the central and local from the perspective of rights, and then lead into the theme of local autonomy.Local autonomy is different from local governance. Local autonomy has the dual nature of rights and power. We also compare the practice and the development of local autonomy between China and Japan here, which provides theoretical support and foreshadowing for the exposition of the legalizing of the central-local relationship below.Thirdly, based on the analyzation of the first two parts, we dissertate the topic around the legalizing of the central-local relationship. We elaborated the theory and practical necessity of the legalizing of the central-local relationship, mainly from the perspective of local autonomy. Here we also analyze the problems in the process of the legalizing of the central-local relationship, and combining with the experience of Japanese local autonomy practice,we analyze the ways to solve the problems in the process of the legalizing of the central-local relationship under the current national conditions.
