Research On The Humanism Justice Of Law In The Plays Of Shakespeare

Shakespeare is not only an outstanding writer,but a great thinker as well.The author examined Shakespeare’s plays from an interdisciplinary perspective of both law and literature,and found that most of the plays have a legal subject of a core idea pursuing justice.Justice is a topic with lasting charms,and we can draw different concepts of justice from different angles such as moral,political and legislative aspects.This article studied justice from a point of view of legislation,and believed that legal justice is justice of forms,which is centered at realizing justice and ensuring that the law can run along the path of justice.Deeply influenced by the times,Shakespeare’s view of legal justice was committed to humanistic care,advocating a humanity-oriented value and respecting human dignity,which formed a view of humanistic legal justice.Shakespeare presents humanistic legal justice in the form of play in front of the world,enabling people to feel Shakespeare’s thinking about legal justice and the concern about the dignity of human dignity through the theater.By analyzing the plays of Shakespeare,the author believed that the view of humanistic legal justice in Shakespeare’s plays is a value cored at the respect of human dignity.To be more specific: human dignity is the goal of legal justice;morality is the inner basis for the realization of human dignity;and law is the external guarantee of human dignity.Based on the view of humanistic legal justice in Shakespeare’s play,with an understanding of the reality of the legislation in China,the author found that there are three deficiencies in the field of protecting human dignity: 1.the correct dignity concepts were failed to established;2.the phenomenon of neglecting one’s or the others’ dignity widespread;3.the shortcomings in legal norms and judicial practices.Shakespeare’s humanistic view of legal justice in plays is able to arise the respect for human dignity.This universal value concept can pass across time and space,and provide relevant reference for our country in protection of human dignity.To this end,the author made recommendations for human dignity protections from both moral and legal aspects: on the one hand,consolidate the moral foundation and urge people set up right concepts of dignity through strengthening ideological and moral education,make human dignity the ultimate value of human values,and finally framework positive moral atmospheres in the whole society attaching great importance to human dignity.On the other hand,we should strengthen legal protections.First,improve the constitutional provisions on the protection of human dignity,and enhance the constitutional status of human dignity;Secondly,improve the civil law provisions,particularly provisions that concern human dignity protection should be added to the new civil code.At the same time,the judicial branches and their staff members should stick to the consciousness of people-oriented service,firmly establish the concept of rightorientation,effectively change the old work attitude,and thereby enhance the judicial protection of human dignity.
