Research On Copyright Protection And Rationality Of Library Electronic Document In Network Environment

In today's digital age and network context,the digital resources and electronic literature storing in the digital libraries have played an increasingly import-ant role on the dissemination of information and culture,both on speed and quality,which is incomparable to the traditional paper literature.Nowadays,as intellectual property rights are gaining more and more attention,digital resources in the network environment are no longer beyond legal regulation.It has become a concern and had to be studied seriously: how to protect the intellectual property rights in electronic literature,digital publications as well as other electronic data,and how to sensibly take advantage of the digital resources and electronic literature in the scope of the law permit!From defining the related concepts as the starting point,this paper systematically introduces the concepts and contents about the copyright of electronic document,the fair use of copyright,the digital library and electronic literature database;and interprets the significant meaning of the related concepts in clarifying the copyright protection object,the protection limit and the scope of rational use.By substantively explaining the contents and extensions of the electronic literature copyright,the reasonable use of copyright and the electronic literature database,the result is that the above-mentioned contents all belong to the management scope of copyright law.After defining the relevant concepts of the copyright protection and the reasonable use of library electronic literature,then the paper explores the risks of copyright protection of library electronic literature under the network environment.Through the research,it is see that the contradiction between the rapid development of information network technology and the natural lag of laws and regulations is the main challenge for the protection of electronic literature copyright.The Internet,from nothing,from a small number of users to a surge in the number of Internet users,and then to the information network technology,has completely affected the existence pattern of library documents;the process is so fast that no one expected.Although the extension of copyright content is very broad,the electronic documents and electronic data as the protection object of this law,but the malpractice caused by the broad boundaries of content is that the objects of regulation are very vague.So,it is difficult to accurately judge the legality of acts in practice.On one hand,the efficiency of electronic documents use tends to be reduced;on the other hand,the risk of illegal use of electronic documents is increased while the copyright owner's legitimate rights and interests are not protected by law.As a result,the principle of the reasonable use of copyright law is questioned because it cannot easily distinguish the rational use and the unreasonable use.At the same time,the copyright problems existing in the second-hand documents cannot be neglected;otherwise,the damaged ones will be the copyright owners directly.If we attempt to solve these problems,we must adhere to the balance and perfection between copyright protection and fair use.The balance between the use of electronic documents and the interests of the copyright owner is to balance the rational use of electronic documents and the copyright owner's interests—the interests of the copyright owner is the main purpose of copyright protection.The use of digital watermarking,client authentication,data encryption,information verification,identity authentication,access control,password storage technology can be a good solution to the problem of copyright protection of electronic documents right.For the rational use of the electronic documents in library,it must be resolved through legal channels: continually improving the determination scope of fair use in copyright law,formulating detailed standards.According to the development of information technology,the scope of the rational use should be expanded from the traditional environment to the non-profit the library,archives,research institutes and other institutions.The content of the legal system should keep up with the pace of information technology to maximum extent,and the statutory licensing mechanism should be further improved to ensure the balance between the interests of copyright protection and rational use.
