Study On The Legal System Of Public Officials’ Conflict Of Interest Prevention

Corruption is a historical and worldwide problem.The basic consensus among the countries in the process of corruption governance is that the conflict of interest of public officials is the main cause of corruption.Conflict of interests,which means in the official activities,because the inducement of private interests affect or may affect the normal exercise of public power,resulting in the public interest and private interests against each other.This paper takes the legal mechanism of confronting public officials’ conflict of interest as study object,content is as follows:Part one: the basic theory of the legal system of confronting conflict of interest.Firstly,author defined the concept of public official,interest,conflict of interest.Then,author discussed the types and the actual harm of conflicts of interest.Finally,author introduced the main mechanism of confronting conflict of interest.Part two: the analysis of legal status of confronting conflict of interest in our country.The author combed the relevant laws and policies on the confronting conflicts of interest,and summarized the shortcomings of our system.Part three: legal analysis and reference of advanced countries and regions.In this chapter,the author elaborated the America’s and Hong Kong’s legal system of conflict prevention and summarized its advantages,hoping to construct and implement the system of confronting conflict of interest in our country.The last part: solutions.First of all,the author argued enacting a conflict of interest law,and discussed the necessity and feasibility of the legislation,the guiding principles and the legislative model.Secondly,the author made an idea of the basic framework and content of the law,including general content,basic system content,supervision mechanism and legal responsibility.Finally,the author proposes to improve the support means,such as obtaining the support of the people,improving the salaries of public officials and improving the education of clean government.
