On The Determination Of The Lower Limit Of The Age Of Criminal Responsibility

The criminal responsibility system of our country currently applied,the legislative mode of the basic use of the age of criminal responsibility across the board ",from the theoretical and Applied Criminology field completely absorbed the classical libertarianism,one-sided emphasis on and clear to determine the strict provisions of criminal law,from the social practice,resulting in a minor judicial practice implementation some of the serious harm social behavior is more and more indulgent,caused more social problems.The juvenile delinquency for punishment system is more single,and we need to improve our country's juvenile criminal justice system.Therefore,I learned of the two legal systems of several countries criminal law on juvenile crime,through induction,comparison of various systems and compares,pointed out that China's criminal legislation on juvenile criminal responsibility age defects,learn from the advanced countries and areas,and puts forward some suggestions.My article will discuss my views in four parts.The first part points out the influence of the legislation on the age of criminal responsibility on the juvenile delinquency,the brutality and violence of the juvenile delinquency.First of all,it analyzes the relevant cases of juvenile delinquency in recent years,and points out the role of the current age of criminal responsibility legislation in it.The second part analyzes the legislative defects of China's criminal law on the age system of criminal responsibility.The third part analyzes the legislative basis of the age of criminal responsibility.The fourth part puts forward the legislative proposals on the age of criminal responsibility.On the basis of analyzing and studying the criminal responsibility of minors,this article gives some legislative suggestions and measures according to the current criminal law.
