Our Country Should Maintain The Age Of Criminal Responsibility Of Juvenile Delinquency

With the development of the society,juvenile delinquency is characterized by low age,cruel means and serious consequences.How to regulate juvenile delinquency,how to prevent crime and punish crime is an urgent problem to be solved.In this context,the development and improvement of China’s criminal liability age system has attracted much attention.As an important part of criminal law system,the age system of criminal liability is an important sign to measure whether a country’s criminal law system is perfect.The dedicated to the development of our country become a country with a light punishment punishment cautiously,as criminal responsibility and penalty system,the system of the join points,such as criminal procedure law,one of the system of criminal responsibility age,apparently to prevent crime and reducing crime and maintaining social stability is of great importance.Therefore,to perfect this system is one of the important tasks of criminal legislation in China.Combined with the actual situation in our country,it’s minimum criminal responsibility age this focus problem a multi-angle,multidisciplinary perspective,is conducive to complete in the system of our country’s criminal responsibility age,is advantageous to the scientific criminal law system in our country.The thesis is divided into five parts:The first part raises questions through two typical cases.Whether the minimum age of criminal responsibility should be reduced must be based on the public case which reflects the characteristics of juvenile delinquency,so as to give people a sense of reality.The second part introduces some viewpoints about the dispute of the age of criminal responsibility in China.Through the analysis of the decrease of Chinese scholars’ holding,the author puts forward several viewpoints and reasons to improve the theory and maintenance,and then puts forward the viewpoints to be proved in this paper.The third part discusses the social science basis of maintaining the minimum age of criminal responsibility in China.Through the concrete analysis of sociology and psychology,the conclusion of the age starting point of the juvenile criminal responsibility is obtained.The fourth part discusses the legal basis for maintaining the minimum age of criminal responsibility in China.Through the specific analysis of administrative law,criminal policy and criminal jurisprudence,this paper will support the discussion of the existing provisions on the age of juvenile criminal responsibility.The fifth part puts forward some personal Suggestions on how to construct the supporting mechanism of maintaining the minimum age of criminal responsibility.There are some deficiencies in the current age system of juvenile criminal liability,so it is necessary to rebuild and improve various supporting measures to more effectively regulate and prevent and control juvenile delinquency.
