With the substantial increase of productivity in China,and the growing pace of urbanization and industrialization,urban land is in short supply and the unbalanced situation of a large number of the township land will seriously restrict the economic development in the rapid development of the economy.Urban housing prices remain high and still in the trend of growing taller,the existing state-owned construction land indicators cannot meet the city's development and construction,so the system of the rural collective management of land into the market circulation has arisen widespread concern since proposed by the scholars.Since the emergence of land circulation problems,the government has long been monopolizing the land market with the role of public power,and the Land Management Law and other laws also provide for the transfer of land into the government to take the land to change the nature of land as a prerequisite for the state,which have inspired the government to take "low into the high" approach to the transfer of land after the expropriation practice.Once the transfer of land inevitably violates the rights of rural collective economic organizations and farmers,it became a nightmare for the peasants,leading a large number of mass riots and petitions.Under this social background,after discussing in many meetings the country finally put forward the requirements of land reform in the CPC Central Committee on Promoting Rural Reform and Development of A Number of Major Issues in the Decision at Third Plenary Session in 2008,and at the Third Plenary Session of the 18th CPC Central Committee in 2013 issued the CPC Central Committee on the Comprehensive Deepening Reform of A Number of Major Issues of the Decision on the collective management of land entering into the city to deepen the understanding and in 2015 furtherly carry out 33 regional pilot in the nationwide.These pilot areas are located in almost all provinces of the country,piloting on the basis of different inherent economies in each region,which is in line with our national conditions.Pilot practice have been for nearly two years and a number of areas have issued the regulations of the collective management of land into the city,which lead to advice or ask questions for solutions.The country also co-ordinates the policy documents issued by various regions,analyze the problems which have occurred in the practice of collective management of land using,and furtherly explores the collective management of land reforming on the basis of the existing practice.From analysis of the existing collective management of construction land into the market summary,the related existing supporting system is not perfect,the main object and land property are not clear enough and the conflict of distribution among the government,the rural collective economic organizations and the internal of the members is the most pressing issue after the land entering the market.In this paper,basing on the knowledge of law and combining with administrative management,economics and other related disciplines on the existing representative practical experience of a summary analysis,the author uses the literature researching method,theoretical analysis,experience summary method and other research methods to find a solution to the problem on the basis of experience and meaning.
