Research On The Age Of Marriage In Ancient China And Its Contemporary Significance

In our ancient society,the productive forces are not developed,science and technology are relatively backward,all social production are dependent on humanactivities,the number of people has become an important factor affecting social development.Therefore,in ancient times the age of marriage and age of childbearing age is not separated from the time,people get married at that time has obviously become an important factor affecting the level of social politics and economic development.Therefore,the ancient Chinese society rulers or based on social development or out of their own political needs,will develop a different legal marriage age.This paper first elaborates the concept of ancient age of marriage in China and the relationship between legal age and adult age.Then,through the study of the legislation and practice of marriage age in ancient dynasties,the author draws the legislative model and concrete contents of the legal age of marriage in our country.On this basis,the specific practice of the legislation of the age of marriage in ancient China was studied.Finally,through the analysis of the effect of the ancient legal age of marriage in China,the author draws the necessity and rationality of the legal age of legal marriage in the traditional society of our country.On this basis,the "male 22 years old and female 20 years old" Of the minimum legal age of marriage.In the process of collecting materials,we find that the stipulation of the age of legal marriage in ancient Chinese society coincides with the Christian church decree of western countries in the same period,which reflects the lower legal marriage age in ancient China Legislation is necessary for its existence.Throughout the world trend,the law of most countries clearly stipulates that men and women over 18 years of age or 16 years of age marriage is a legitimate marriage,protected by law,significantly lower than our current "male 22 years old,20 years old" legal age.The United Nations Human Rights Committee and international human rights organizations also believe that men and women are 15 years old and their marriages are legitimate and should be protected by law.The countries of the world and regions can,according to their economic,political and cultural education,Customs,etc.,to develop a marriage in line with the national age policy,but generally should not be greater than 20 years old.Thus,China’s current "Marriage Law" in the "male 22 years old,female 20 years of age," the statutory minimum marriage age is not in line with the development of the times,but also with our ancient marriage age legislation is far from the provisions.This article mainly through the study of the ancient age of marriage in our country,with a view to finding out the solution of the "highest legal marital age problem" in our country’s society today,and finally come to the conclusion that the present situation The legal age of legal marriages,and the legislative advice on the future reduction of legal marriages.
