Analysis Of China-Measures Imposing Anti-dumping Duties On High-performance Stainless Steel Seamless Tubes ("HP-SSST") From The European Union

The world economy is in a gradually descending line,since the economic crisis in 2008.In order to protect the domestic market,trade protection is on the rise in many countries.Anti-dumping measure as a convenient and efficient means of trade protection is likely used by countries.Analysis on anti-dumping cases has important significance to China for how to deal with the foreign anti-dumping measures as well as anti-dumping action against foreign countries.Information disclosure and business confidential information protection are two often commonly controversies in anti-dumping cases.Also,the two controversies relate to the problems of anti-dumping investigation,the protection of stakeholders' right,and so on.In a word,the two controversies can not be avoided in anti-dumping case.however at present,the academic research is relatively small and mostly in the preliminary discussion stage.The academic view on how to deal with the controversies of the information disclosure and business confidential information protection having not been formed.In this essay,the author tries to provide some possible suggestions on dealing with the two controversies.This essay use China—Measures Imposing Anti-Dumping Duties on High-Performance Stainless Steel Seamless Tubes(“HP-SSST”)from the European Union as the example case.Using the case as an entrance,the author tries to investigate the better solution to deal with the contradiction between the information disclosure and the business confidential information protection in anti-dumping cases.The whole essay is divided into four parts:The first part is the brief introduction of the case and introduces the background,reasons,and the main contradictions focus on this case.The second part is some analysis on the information disclosure of the contradictions.In the beginning of the second part,the author explains the concept of information disclosure.And then analyzes the significance of information disclosure.In the end of this part,combining with the case,the author investigates the essential facts,disclosure mode which relates to the information disclosure.The third part is some analysis on business confidential information of the contradictions.This part begins with the concept of business confidential information protection.Then the author analyzes the significance of the business confidential information production.In the end of this part,combining with the case,the author investigates the good causes,non-confidential summary which relates to the business confidential information protection.The fourth part is the thinking and enlightenment of the Case.In the first,the author sets out the contradictions between the information disclosure and business confidential information protection.The author detail analyzes the existing different contradictions,such as the contradiction between interest and order,different rights contradiction and contradiction between truth and confidential information production.After sets out the contradictions,the author tries to give some suggestions on how to deal with the contradictions between the information disclosure and the business confidential information protection.The author tries to discover a solution to solve the contradictions.
