The publicity of government information is an indispensable part of the legal system for the citizens of a modern democratic country to achieve their right to be informed, to supervise the government and to participate in politics. But, in order to safeguard state security, some specific information must be kept as state secrets, limiting the publicity of the government to some extent. Therefore, most countries treat state secrets as a part of the restrictions of the publicity of the government. Information resources are important strategic resources of a country. State secrets, as one of the information resources, are closely associated with a country’s survival and development. It is part of the core content to regulate the confidentiality of information resources through the legislation of information law. But at the present stage, the development of new science and technology has brought great threat to the protection of state secrets. There exist different degrees of disclosure of state secrets. Under the background of the publicity of government, the legislation of confidentiality conflict with publicity in coherence. The phenomenon that the legislation of confidentiality is not well cooperated with publicity should be adjusted. The present paper has conducted a comparative study on other countries’ legislation of state secrets and their advantages which can be learned from. What’s more, empirical study has been utilized to investigate the disadvantages in the practices of government’s information confidentiality in our country. And then, the program and plan of perfecting the legislation of government information have been proposed.
