Chinese “artificial intelligence” is translated by English Artificial(artificial,simulated)Intelligence(intellect,comprehension,clever),as the name suggests,it is the subject that focus on the research and development about simulation,extension of human intelligence.In recent years,the "wisdom" of artificial intelligence has been changed rapidly,which has become a new talent in the field of literature and art.As a newcomer in the field of literature and art,the talent of artificial intelligence in writting the press release can save a lot of manpower cost and time cost for employing units,and the paintings finished automatically in accordance with the procedures by artificial intelligence are showing the ultimate visual feast for us.With the increasing popularity of artificial intelligence,the form of the press release,songs,paintings finished by artificial intelligence seems quite similar with the achievements of mankind,so can these results be protected by the Copyright Law? However,the works protected by the Copyright law shall contain human intelligence.There is human intelligence or not in the artificial intelligence achievements will affect the legal position of artificial intelligence achievements.This article will start with the artificial intelligence in the field of literature and art,to study the legal sense of artificial intelligence.The first part of this article lists three representative examples to illustrate the amazing success of artificial intelligence in terms of press writing,arranging and painting,then introduces the different stages of the development of artificial intelligence,and simply expresses the characteristics of artificial intelligence at different stages.Then The author analyzes the infinite potential and the risk of artificial intelligence in the era of large data,and puts forward the central thesis of this paper which is how to solve the instability of the legal status of artificial intelligence achievements.The second part discusses the necessity for legal adjustment of artificial intelligence outcomes.First,the popularity of artificial intelligence leads to the surge in the number of artificial intelligence outcomes,and the instability of its legal status may make the use of the results ineffective or individual agency cost too much.Besides,investors are the leading pioneer in the development of the artificial industry,in addition to their own interests and lofty ambitions,the driving force of itsinvestment is the consideration of interests.Profit is the nature of businessmen.If the investor's research will promote the social welfare and People's well-being,it should receive positive evaluation from the law.The protection of the interests of investors should also be considered as a factor.In addition,the development of the artificial intelligence industry requires the potential incentive stability of the legal interests,the demand of the public for the results of artificial intelligence should also be satisfied with legal.With the rapid development of artificial intelligence,we need legal to adjust the complex social relationship,but the law and related legal research is in a blank state.The third part evaluates the results of artificial intelligence from the perspective of the object of copyright law.As the expression of artificial intelligence results is highly similar to the human intelligence achievement,Locke's labor theory not only provides a proper explanation for copyright law,but also imposes restrictions on the object of copyright law.Therefore,the author discuss whether the results of artificial intelligence can become works of copyright law drawing lessons from Locke's labor theory.Originality is the necessary condition of the work.So in this paper,the next step is to explore whether the results of artificial intelligence has originality.The fourth part,as the conclusion of this article,discusses the legal adjustment of artificial intelligence outcomes under different conditions.The main focus of the analysis of the results of artificial intelligence that can be regarded as the result of human intelligence is the attribution of rights.For the artificial intelligence that is not the subject of copyright law,to meet the needs of the industry and the interests of investors,we should create a "class of copyright".
