Research On Copyright Of Artificial Intelligence Works

With the development of social economy and the rapid progress of science and technology,artificial intelligence technology is more and more widely used in various fields.artificial intelligence works come in various forms,including but not limited to novels,news reports,poems,paintings,music,video,etc.This paper starts from the composition of the research work and the main position of artificial intelligence,and then discusses the nature of artificial intelligence creation and the mode of ownership of its rights,then discusses the content of rights and the way of protection of works,and proposes the solution of the current copyright law applied to the copyright problem of artificial intelligence works.The first part of the article defines AI and AI works.Firstly,it introduces the process of artificial intelligence from rise to development to current technical level and possible development direction in the future.Secondly,the detailed understanding of the working principle of artificial intelligence and the process of the creation of artificial intelligence works are different from the process of creation of human works.According to the types of artificial intelligence itself--weak artificial intelligence and strong artificial intelligence--the AI works will be divided into corresponding two categories,auxiliary type and independent creation type,so as to facilitate subsequent analysis.The second part discusses the identification of artificial intelligence works.According to the definition and analysis of works under the framework of the existing copyright system,the works created by artificial intelligence conform to the requirements of the existing work law,and are intellectual achievements in the field of literature,art and science.They are original,reproducible and constitute works under the copyright law.The third part discusses the ownership of the copyright of AI works.Firstly,by analyzing the traditional copyright theory,the current ownership model of copyright system is analyzed.Among them,the copyright system country and the author rights system country are different,but the model of our country has the reference and has the difference.Secondly,compare the situation of the AI works to find out the places where both parties cannot apply.Finally,through the analysis of the main status of human and AI in the AI creation process,the ownership of the AI works is further analyzed.The fourth part proposes consummate Suggestions on the deficiencies of the traditional copyright system in the face of the copyright problems of AI works,constructs the applicable protection system for AI works,and discusses the remaining elements of the AI copyright protection system,including the content of rights,the method of rights acquisition,the term of protection and the responsibility bearing.
