With the rapid development of our national economy,the PPP mode has been increasingly applied to infrastructure construction and public service fields.PPP refers to construction projects of public-private partnerships,in which government can improve public service quality and infrastructure management through the cooperation with social capital parties.The application of PPP mode brings a win-win situation to both government and social capital parties.On one hand,it fills investment gap hardly covered by governmental or social capital alone and expedites the construction of public infrastructure;on the other hand,it brings remarkable profit for social capital parties,activates market capital and promotes resource configuration.The promotion of PPP mode relies on solid policy basis,rich practical experience and more on complete and stable legal system and supervision environment.Nevertheless,due to short develop-pment time,our country hasn't still established complete legal and institutional system about PPP.Therefore,legal risks become an important problem concerned by related parties during the development of PPP.Base on this,this thesis carries out research around legal risk identification and control in PPP mode.The first chapter of this thesis is introduction,the second one mainly analyzes the basic theory of PPP mode,introduces its concept and characteristics,summarizes its subjects of legal relations.In the third chapter,the legal risks in PPP mode are identified through some specific cases.Based on the analysis about basic theories of legal risks,PPP legal risks are classified into four classes according to different risk-incurring factors.The fourth chapter of this thesis is about referencing overseas experience about PPP mode development,mainly studies PPP legal systems in England and Australia.The fifth chapter is about some suggestions about establishing PPP legal systems.
