Study On Court Judgement Documents Publication System Based On Public Acquisition Right Perspective

Judgment documents are legally binding to the written judicial decision which made by people's court according to lawsuit case facts and the law,which is the result of the people's court to exercise jurisdiction over a case and also reflects national will.As decision verdict made by the Court,judgment documents are not only the result of judicial process,but also justice's“instructions”of judicial activities.Moreover,it is an important carrier for general public to implement judicial supervision directly and intuitively,which has public goods nature.Therefore,judicial publicity has been the main content of judicial reform our country has promoted in recent years.For so long,in addition to participants in proceeding,public's acquisition right in justice field is often fulfilled through press circles,publishing industry,and timely reports on specific news events,major cases of legal basis and factual basis.The fact of judicial publicity is that the public can only know what authorities report,which apparently does not agree with public's acquisition right connotation.Provisions on the People's Court Publishing Judgement Documents on the Internet issued by the Supreme People's Court on November 13^th of 2013 and having been implemented from January 1^st of 2014,made clear and specific stipulations online about judgement documents'publication form,publication scopes,responsibilities of courts at all levels,and so on.However,after this provision was issued,there have existed problems like small number and narrow scope of publication documents of courts at all levels,ambiguity of theoretical basis and function position of judgement documents online publication,disunion of document formats and scopes.Taking judgement publication system as theoretical base,on the basis of public acquisition right perspective,with public administration and public service as guidance,starting from current judgement documents online publication situation,trying to find out problems of judgement documents online publication system,this thesis proposed some countermeasure and suggestions to optimize judgement documents online publication system.This thesis's core demonstration contents include 3 parts:Through expounding the relationship between public acquisition right and court judgement documents,chapter 3interpreted court judgement documents'property of public goods and the important significance of judgement publication to realize public acquisition right;through data collection and questionnaire survey on Ordos City Intermediate People's Court and Ordos City Basic People's Court,chapter 4 conducted survey and analysis on judgement documents online publication situation on cases with high public attention degree and large influence field in investigation area,and conducted analysis on the supply and demand of judgement documents'online publication system from public administration perspective;chapter 5 put forward some countermeasures and suggestions to establish thorough judgement documents publication system.About system improvement aspects,made some expositions from personnel allocation,equipment demand,supervision evaluation and other aspects of court judgement documents publication system.
