The Resolution of the CPC Central Committee on Certain Major Issues Concerning Comprehensively Advancing the Law-Based Governance of China was approved in The Fourth Plenary Session of the 18 th Central Committee of the Communist Party of China(CPC).It was noted at the session that,it embodies the new height of the CPC’s awareness of the legal system construction,it is also the needs to solve the realistic problem.There will be no revolutionary movement without revolutionary theory.Comprehensively advancing the law-based governance of China,which needs a suite of more scientific,more comprehensive,and relevant guidance of scientific theory in current and practical Chinese social.While such a theoretical must be summary,concise,and promotion from the great practice of legal construction in our socialistic society.This paper based on the situation of the country and the society,the public opinion in China.Try to start with the establishment the basic connotation of the legal country,it hinges around the interrelated thesis of building the legal country from Marxism classical writers,Combs the basic standard of building a country governed according to law,analyzes the necessary conditions for the construction of the Chinese characteristic socialism country under the rule of law,studies the distinct characteristics of the construction of the rule of law in our country,which use the experience and characteristics of national construction between Chinese and Western law.The rule of law,that is,the state power,especially the administrative power must be exercised in accordance with the law of the country.Many theoretical elaboration of the socialist regime construction and legal system construction,wrote by Marxist classical writers,provides a scientific theoretical guidance for the construction of the rule of law in China.The so-called construction of legal country,at first,we must have mature and stable modern democratic political system;second,we must improve the sound legal system;third,we must set up the scientific,standardized and clean national institutions.The new political system,the leadership of the Communist Party of China,the sound legal system,the administration of the government according to law,the independent and judicial system are indispensable conditions for the construction of the socialist country with Chinese characteristics.In addition,,from the practice of Western countries in the rule of law,we can avoid weaknesses,adhere to the quality of Marxist political parties,bold criticism,critical inheritance,remove dross,learn the essence,provide a useful reference for the socialist rule of law.
