China's population will age rapidly in the very near future.Over the past decade,China's housing and land policy has undergone major changes,urban residents have a steady rise in housing ownership,the vast majority of urban residents have property rights.The financial products to solve the aging of the population has a housing shortage of funds but the situation,since then,Canada,Singapore,Russia,Japan,Britain,New Zealand,India and other countries have been implemented.The reverse mortgage is"house-for-pension" mode,the pension system and the concept of innovation in the protection of reverse mortgages in foreign operation for more than ten years,has proved to be an effective way to alleviate the problem of aging.However,there are a lot of legal risks in the operation of reverse mortgage,which hinders the implementation of reverse mortgage.Because the housing reverse mortgage is a kind of financial contract without recourse,the borrower has no income requirements,therefore,it's high risk characteristics are particularly prominent.On the one hand,due to the special nature of the contract,the borrower's gender,age,health status of the loan contract will affect revenue uncertainty.On the other hand,the object of the contract value is affected by many factors,the national macroeconomic policy,such as interest rate adjustment.Housing policy changes,small house value estimation and housing depreciation,maintenance and so on.In addition,lenders must bear the cost of the risk,and the borrower's credit status will bring greater influence to loan income,so whether it is reasonable to control the risk of housing reverse mortgage loan is the key to the success of financial products.This paper expounds the following five parts,the first part is related to the concept of housing reverse mortgage loan is defined,and the provision of the law of reverse mortgage related;the second part is to analyze the development status of reverse mortgage in China,and from the elderly dependency ratio,households homeownership rate acceptance,reverse mortgage endowment pattern,changing trend of commercial housing price index was analyzed;the third part discusses the legal risks of housing reverse mortgage loan,and the reasons behind the risk;the fourth part is the comparative research on the reverse mortgage operation in major countries and regions,and summarize its experience and lessons in China,to find a suitable place to study;the fifth part is through the above analysis,put forward the legal risk prevention of China's housing reverse mortgage loan Fan's proposal.In this paper,through the research on the problem of the legal risk of housing reverse mortgage loan system,to the scope of the law,combined with the basic situation of our country,the construction of housing reverse mortgage system and its supporting system from the perspective of risk prevention and risk control,to prevent the risk of trying to solve related problems in the legal level.
