Research On Virtual Property Right Change Rule

Virtual property,a new type of rapidly developing property which comes into being as human beings marched into the information society.Virtual property brings both opportunities and challenges to the traditional Civil Law Legal System.Currently,researches on virtual property are only about its legal attributes instead of its right change rule,not to mention corresponding civil legislation.This dissertation is mainly about virtual property's legal attribute as an object of civil relation and its essence of right after being identified as object.In the end,this paper discusses virtual property right change from four aspects: effect,reason,elements and exceptions.This paper includes the following four chapters:The first chapter,Introduction.This part concisely elaborates the background,status quo,methods and significance of this research.The second chapter,The Basics of virtual property.This part is mainly about virtual property's scientific positioning and its identification of legal object.The third chapter,virtual property's essence of right.This part discusses virtual property's essence of property right and disposition right.As disposition right,virtual property rights need to be assisted by software,hardware and specific aider.As property right,Virtual property is a special kind of movable property,and can be set up ownership and real rights for security.The fourth chapter,design of virtual property's right change rule.This part first discusses the premise of virtual property's right change rules from the technical feasibility,the necessity of establishing virtual property real right change mode and legal resources.Secondly discusses the effect,reason and elements of virtual property's right change rules and virtual property's bona fide acquisition system.
