Reflections And Resolutions On The Protection Of Children's Sexual Rights In China

Recently,due to frequent occurrence of child sexual abuse,the problem of sexual assaults aiming to children is going from bad to worse.Despite the approval of Convention on Children's Rights,which is known as the “Charter for Protection of Children's Rights”,and the establishment of a relatively completed domestic legal system,there are still much potentials to improve in the protection of children's sexual rights.Accordingly,this paper,from perspectives of education and law,aims to set out present problems and state a direction to solve them in some ways pursuant to the investigation on children 's consciousness of sexual rights and the analysis to legal norms of children' s sexual rights in China.Meanwhile,it also tries to demonstrate children's sexual rights,which may be of great value in deed as to recognize children's independence and prevent children from sexual abuses.There are four parts in this paper other than introduction and conclusion:The first part gives a certification of theory for children's sexual rights in terms of human rights.In this part,the author specifies that child is the subject to enjoy sexual rights by discussing human as the purpose,child as the subject of human rights and sexual rights as the basic human rights,and analyzes characteristics of sexual rights.The second part,in accordance with data from “Questionnaire Survey for Children's Sexual Abuse Prevention Education in Chongqing” conducted by us under the entrustment of Chongqing Children's Fund,points out several main consciousness problems encountered by three subjects(primary school students,parents and faculties)in children's sexual abuse prevention through an analysis of sexual right awareness of certain primary school students,their parents and faculties in Chongqing.The third part discusses some predicaments existed during the protection of children's sexual rights in China.The first is cultural predicament,which is mainly due to the negative effect on the protection of children's sexual rights from the traditional shame culture;the second is legal predicament,which is principally related to defects under legal regulations and problems in practice;the third is inadequate sexual education,which refers to the sexual education both in the family and in the school.The fourth part puts forward the direction to protect children's sexual rights.In details,it should establish a concept that child is the subject of sexual rights and child's interest should be maximized in culture;it should furtherly improve the norms and systems in law;and it should strengthen the connection and cooperation between schools and families in education.
