Judge staff reform is an important measure to promote the process of professional judges,has become the focus of this judicial reform,this is known as the most difficult personnel system reform has been implemented nationwide.The reform of the judicial staff system is closely related to the reform of the judicial management system and the breakthrough of the reform of the judicial management system.Therefore,the reform of the judicial staff system is of great significance.Any reform involving the personnel system is not easy,and the same is true of the reform of the post of judges,and there are many problems in the process of reform,and it is necessary to carry out an in-depth study on the reform of the post of judges.This article consists of the introduction,the text,and the conclusion.The text is divided into three parts.The first part outlines the background and content of the reform of the staff member system and the relationship with the reform of the Court's management system.Judge staff reform has experienced three stages of early budding,medium-term exploration and development.These three stages have carried out relevant explorations on the reform of the post of judges,and have gained some experience in reform.Clarify the meaning and objectives of the reform of the Judges' staffing system and the achievements achieved in the current pilot reform of the staffing system.Judge staff reform and court management system reform are mutually reinforcing relationships.On the one hand,the reform of the judicial staff system is an important part of the reform of the court management system,which is the breakthrough of the reform of the judicial management system.On the other hand,the comprehensive implementation of the reform of the judicial system of judges is inseparable from the overall promotion of the reform of the court management system.affect each other.The second section outlines the current plight of the reform of the system of judges.Dilemma One is that the reform of the system of judges' facsimile relies on local pilot reform models to create a series of problems.First,relying solely on the local pilot reform model to make the reform become a means of highlighting the performance;the last purely,the purely The top-down reform model has led to the lack of endogenous motivation in the reform of the post of judges.The dilemma is the lack of supporting measures for the reform of the post of judges.One is the lack of a complete mechanism of assistant judges to lead to the current lack of a large number of judges assistant,did not achieve the judge from the complex non-trialaffairs in the liberation of the purpose.Second,the judges occupational insurance mechanism is not perfect,the court brain drain serious.The third is the lack of judges diversion mechanism,hindering the process of reform of the post of judges.Dilemma three is the administration of the judicial management system,hindering the pace of reform of the judges staff system.By the traditional culture and historical reasons,our country judge system is inherently deficient,and the administrative problem of court administration is still outstanding.The third part explores the path of the reform of the post of judges.In order to solve the problems brought about by the local reform model alone,it is necessary to establish a national judicial reform coordinating body to strengthen the co-ordination and control of reform.The establishment of the reform of the scientific assessment of institutions and the identity of the incentive mechanism based on the diversification of the incentive model to address the reform of the scientific assessment of the problem and the lack of endogenous motivation,and should strengthen the judge staff reform system to promote the overall measures to improve the judge Into the mechanism and the judges of the occupational security mechanism,improve the judge diversion mechanism to achieve the effective transfer of non-entry judges,and finally gradually promote the judicial management system reform to the administrative process.
