Research Of The Maintain Management Of Invention Patents Of Different Natures Granted In China

In set of the intellectual property strategy and the strategy of the innovation-drivendevelopment,there becomes a consensus that to strengthen the utilization of intellectual property information and improve the ability of using patent data.By empirical analysis of the patent data and the factors of the maintenance time,people could find the law of using patents,improve the ability of patents management and promote the patents quality.Finally,we can perfect the patents maintenance management system.On the basis of summarizing the existing research,by defining the patents maintain system and other related concepts,this article elaborated the theoretical basis of the patents maintain system from four angles—the public interests,technological innovation,institutional performance and patent strategy.As a part of the system,the maintain system of patent for invention could promote the public interest,enhance the level of innovation and create economic benefits significantly.Therefore,it is important to analyses the maintain mechanism of the patent of invention from the view of empirical research.First of all,this article analyzed the three kinds of natures of invention patents from the angles of legal status,technical field and the number of inventors and then found that in the comparison of the three kinds of invention patents,the termination ratio of product invention patents is the highest,the expiration ratio of product and method patents is the highest and the ratio of power transfer of the method patent is the highest.There are many differences between different invention patents of different nature in different technical fields.For example,in the field of chemical metallurgy,the ratio of method patents is higher than other two,meanwhile in the field of living needs,the ratio of product patents is the highest.In addition,they are relativity between the number of inventors,the nature of invention patents and the innovation subjects.The number of inventors is different between different natures,which means that the number of inventors of the product patents is the lowest.Second,on the basis of the research on related information,this article analyzed the factors which influenced the maintain time of the invention patents.The maintain time is one of the very important factors measuring the quality and value of the invention patents so that the patent holders focus this factor.For this purpose,this article analyzed the relativity of the legal status,the natures of invention patents,the types of invention subjects and the situation of power transfer by SPSS,and then make the regression analysis of the factors of maintain time.The results showed that there are relationship between them.Combined the empirical analysis,the correlation analysis and the regression analysis,this article discovered that there are problems in the behaviors of innovation subjects from the microscopic view: the idea of invention patent management is draggled,the ability of invention patent information management is weak,the concentration degree of invention patents in some technical fields is relatively insufficient and the level of the marketization is low.Finally,in order to improve the ability of invention patents maintain management,this article puts forward the countermeasures and suggestions: strengthen consciousness and establish scientific invention patent management idea,change thinking and promote invention patent information management ability,make reasonable layout and promote the technology invention patent concentration,and establish a mechanism and improve the level of marketization.
