| With the improvement of people’s living standard,the demand of our country more and more express,resource waste and environmental pollution caused by more and more serious,this paper through the investigation and research shows that China’s current express package,several prominent problems: the first is the demand and output of more and more express package;second,the current recovery and the recovery mechanism has not been established,people and businesses have not yet formed the product recycling consciousness;third,the process of recycling of renewable resources,if there is no perfect facilities for recycling resources,investment is also a disguised form of waste;fourth,government propaganda is not strong,the current use of our renewable the resource classification is not obvious,leading people to the product awareness is not strong,often handle relatively trouble.In comparison,the courier packaging and classification of abroad is relatively clear,and the corresponding industry system is high,such as recycling,recycling source management system,funding and other aspects of doing good,worth learning and reference.Combined with the research status at home and abroad are analyzed,introduced in the courier packaging recycling process,organize legal knowledge system to express packaging materials,including the legal system,the system and mechanism construction,classification and recovery mechanism of legal protection.The legal problems in the courier packaging recycling,including the legal system is not perfect,the legal framework is unknown,the main responsibility is not clear,behind the rights and obligations of the responsibility system is not unified,weak supervision,standardization system construction.According to the reasons for the imperfect legal system of express packaging materials recycling,including the conflicts of interests,the conflict between the target of the socialist rule of law and the lag of legal system.This paper is mainly based on the theory of express packaging recycling,including the solid waste pollution prevention and control law,the 3R principle,the express packaging materials and the concept of sustainable development,the theory of circular economy.Combining with the current situation of legislation of major developed countries are analyzed,combined with the United States,Germany,Japan,South Korea,France and other EU countries are analyzed and summed up the Enlightenment of development of foreign express package to China,including the importance of related regulations on joint action,packaging supply chain recycling,strengthen propaganda,actively use the economic cycle theory of the formation of law enforcement habits,improve the sustainable recovery of express package.Ideas put mainly with the current courier packaging material mechanism,including adapting to the development trend in the future,express courier packaging packaging recycling industry system security legislation standard,clear courier packaging material recycling,each link of the subject clear environmental legal responsibility system,the establishment of multi subject qualification,public interest litigation and promote the transformation of law means of courier packaging material recycling technology to promote the development of the promotion and application of green packaging legislation. |
