The solar photovoltaic industry as a national focus on the development of renewable energy industry in recent years,whether at the local or national have been the focus of policy support,the solar energy demonstration project-roof plan and "five photovoltaic industry planning" special funds for energy engineering.With the rapid development of the industry,China's photovoltaic production has leapt to the world's first.Photovoltaic products accounted for 90%of the export volume has reached production,its main export markets in Europe and America,the share of exports accounted for more than 68%of the global market.However,from 2012 to the present,China's PV industry suffered several European and American trade remedy measures.Due to the huge amount involved in the case,the scope of a wide range of China's photovoltaic industry has suffered an unprecedented winter industry.So,for now,renewable energy as a typical representative of the photovoltaic industry,the related subsidy system to further explore and put forward valuable suggestions,for the sustained and healthy development of the photovoltaic industry to provide reference ideas effectively have far-reaching practical value.The first part of the article discusses the EU China PV products"double reverse" the case of a brief description of the PV industry in China at the present stage of the international environment encountered countervailing legal difficulties.Then,combing and analyzing the relevant regulations and policies of domestic solar photovoltaic industry subsidies.And bring it into the relevant WTO system for compliance analysis,and research and analysis of the WTO framework under the renewable energy subsidies exists drawbacks.Contains the "SCM agreement(" agreement on subsidies and countervailing measures")Eighth WTO renewable energy subsidy rules lag and quoted" GATT1994"("the 1994 general agreement on Tariffs and trade regulations ")general exceptions of the uncertainty of the twentieth content.At the end of this paper,according to the foregoing analysis,the author summarizes the legal measures of two dimensions:international and domestic.Including:the domestic level of "exclusive subsidies special" and "exclusive financial direct subsidy","exclusion of prohibited subsidies" and"renewable energy subsidy system to strengthen the international level";"renewable energy subsidy system under the framework of WTO perfect"and "counter measures" and "from abroad the entry into force of the judicial review in the case of groping rescue method" and "will be feasible to strengthen the implementation of anti subsidy rules in bilateral FTA to assist in".The article is to improve the domestic renewable energy subsidy system,so that China's renewable energy industry from the EU countervailing measures to provide ideas to follow.
