In recent years, credit card industry has formed a certain scale, and it is to promote the development of fast forward in China. However, due to the credit card related legislation is not perfect; there are many problems in the process of credit card transactions, the core of which is the legal risk prevention of credit card holders. The existing credit card legal system cannot effectively prevent legal risk of the cardholder, while credit card cardholder is indispensable party in credit card legal relationship, we should pay more attention to legal risk cardholders are facing. Therefore, taking the legal risk and prevention of the cardholder as the main clue, the study of the legal issues related to credit card can provide theoretical reference for our country's credit card legislation practice.This paper study legal risk and prevention of credit card cardholders mainly from the legislation actuality, reference for the legislation, legislative moves. Finally, based on China's actual situation of credit card, in order to better solve the existing problems, it correspondingly proposes specific measures such as improve credit card legislation level, strengthen financial supervision and actively fulfill information disclosure obligation and so on, and further perfect legal risk and prevention system of credit card holders in China.
