The System Establishment Of Drug Addicts' Industrial Injury Relief

The main reason why drug addicts lose their rights and legal relief is the lack of correlative institution and the nonfeasance of enforcement agencies.There are more and more cases about drug addicts getting hurt,even death in a detoxification unit,however,it is rare to find researches on compensation for them.It is good for not only reducing the crime rate but also promoting the construction of law in China through solving the problem caused by drug addicts' industrial injury relief.To ensure the labor rights of drug addicts under control can provide survival skills for them when they get back to society,further more it is propitious to national security and social stability.Although "antidrug law","detoxification ordinances" and "the judicial administrative organ of compulsory isolation detoxification work rules" were implemented in 2008 one after another to demand innovating the detoxification system,they just mentioned the fundamental principles,unfortunately no words to show the drug addicts' industrial injury relief.Currently the national unified law about the drug addicts' industrial injury relief still had a vacancy.This article discusses the system establishment of drug addicts' industrial injury relief from four aspects.First,the introduction is the main content of the treatment of two cases out of the current drug addicts injury problems are neither legitimate nor reasonable,there are many problems.The first chapter,first from the concept of drug addicts labor injury,analysis of drug addicts labor history and drug addicts labor of the purpose and significance,followed by analysis of the current drug treatment personnel injury is how to define,including its legal nature,and a general sense of injury have what distinction inductrial injury treatment,and shall analyze the content by what law legal relationship.The second chapter,starting from the present situation of the current practice of treating drug addicts inductrial injury,based on the legal analysis on the deficiencies and contradictions,the laws and regulations in this regard,puts forward the problems facing drug addicts treatment,including overlapping,compensation standard processing departments unreasonable,settlement,lack of choice and social insurance the system of imputation principles of the five aspects of the problem.The third chapter,mainly expounds some provisions of the United Nations and the world organization for human rights on the right of labor supervision personnel security,as well as the western country practices on the supervision right of labor personnel security implications for drug addicts and reference of Chinese industrial processing of the enlightenment;fourth chapter,discusses how to establish and perfect the system of industrial injury insurance,drug addicts,from four aspects,including the concept of human rights law system to explore the processing mode,and improve the work of judicial remedy the development direction of the content.
