The Third Plenary Session of the 18 th CPC Central Committee puts forward the overall goal of "perfecting and developing the Chinese-characteristic system and promoting the modernization of the governance system and management capacity",It marks the official introduction of the concept of governance in the government's ruling principle.Social governance is different from the traditional administrative management,is a major innovation in the concept of governance.Social governance originates from social autonomy,it emphasizes the collaboration and autonomy between the players.The so-called grassroots people's mediation of social governance is led by the government,relying on civil society organizations,social organizations and other third sector coordination and participation,in order to achieve maximum public interest,rely on people's mediation to resolve social disputes and maintain social harmony,the process of effective management of social order.In the practice of basic management in our country,not only the basic people's mediation system stands the basic function of dispute resolution,but carries the law popularization and cultural integration of functions of the human value fusion,and social management and risk control of political control function.Among them,the grassroots people's mediation function to resolve disputes,is the basis of exerting political control and cultural integration function;and its political and cultural functions,the basis is established in the dispute resolution function.Of course,there exists some practical difficulties in the process of the people's mediation system is working.It Characterized by the weakening of dispute resolution function and the strengthening social control function as well as the part failure of cultural function.These obstacles not only contains systematic obstacles of the system itself,but the social transformation of social and economic structure,which has been changing the way of people's life,and the contradiction between "administrative" and "autonomous" also is an important factor affecting the function of it.In order to give full play to the basic people's mediation system of social management function,we should change our concept,the government implemented the "almighty government" to "limited government",we should prosper the revitalization of the grass-roots mediation organization,enhance the strength of social autonomy,we should balance the relationship between mediation and trial,make the people's mediation system into the orbit of the rule of law.
