Research On The Predicament And Countermeasure Operation Of People's Mediation From The Perspective Of Social Governance

Since the reform and opening up,China's economic and social development has been sustained,and the people's living standards have been steadily improved.However,with the rapid transformation of social structure,the dramatic changes in the pattern of interests,social disorder,psychological imbalance,ethical anomie and other phenomena occur from time to time.Various social conflicts emerge in endlessly.People's mediation,which carries the cultural and ethical values of "harmony",solves disputes through flexible means.It is not only a unique way to solve conflicts and disputes,but also a social governance mode to solve civil disputes and realize the autonomy of the masses,which coincides with the goal and concept of "good governance" in social governance and has high social value.The Fourth Plenary Session of the 19th Central Committee of the Communist Party of China pointed out that "it is a major strategic task for the whole party to modernize the national governance system and governance capacity." As an important part of social governance,people's mediation should be continuously improved and promoted to play its due role in promoting the modernization of national governance system and governance capacity.However,in the process of modernization transformation,due to the transformation of government operation concept,people's life style and the defects of the system itself,the people's mediation work in China is facing a series of difficulties,which can not meet the needs of the development of the new era,especially in the underdeveloped areas in the middle represented by T city of S Province.This paper discusses the significance and function of people's mediation work in promoting social governance,taking the people's mediation work in T city of S Province as an example,points out the current situation of people's mediation work,discusses the effectiveness and shortcomings of people's mediation work,analyzes the difficulties it faces,and then probes into how to improve people's mediation work to make it better.Further,give play to the advantages in social governance,fully meet the needs of social governance,and create a social governance pattern of CO governance and sharing.This paper consists of five parts.The first part discusses the nature and characteristics of people's mediation and social governance,and consistency between the two,The second part,its position and function in promoting grass-roots social governance.The third part,taking T City as an example,studies the construction of people's mediation organizations,teams and institutional mechanisms,and show the overall development of people's mediation work by analyzing the success rate of mediation,the implementation rate of mediation agreements and the conversion rate of disputes.The forth part,analyzes the role of people's mediation in spear The difficulties and causes faced in preventing and resolving disputes,moral propaganda,promoting the construction of the rule of law,social integration,social mobilization and other functions.The fifth part is the countermeasures and suggestions to promote people's mediation function and effectiveness.It includes standardizing the legislation of people's mediation system,consolidating the work basis,promoting the occupation process of mediation,renewing the concept of mediation,innovating propaganda methods,giving full play to the functions of the people's Mediation Association,.realizing the docking with other diversified ways of resolving disputes,improving Internet plus mediation mode,and promoting cooperative governance mode.
