Drug problem has always been the enemy of human society,and raw material and mixture for drugs is the starting point of crime and the source of drugs,how to stop drug items through illegal channels into the society,is one of the important research projects in the comprehensive drug control.At present,our country mainly through criminal law regulation to achieve this purpose,on the basis of the criminal law provisions,the relevant departments according to the provisions of the judicial interpretation,accurately apply the law to regulate raw material and mixture for drugs.Because the resistance brought by the lag of raw material and mixture for drugs crime theory research and legislation,judicial resistance,and other social factors,result in China's drug control situation is still severe.In this paper,through literature research and empirical research,analysis of legislation and the judicial two aspects as a whole,on the basis of the system inductive analysis of the connotation of the raw material and mixture for drugs related behavior such items in the system,analysis the necessity and feasibility of criminal law regulation on the raw material and mixture for drugs related behavior,and focuses on the existing criminal law regulation system,find out the highlight of justice practice in all kinds of shortcomings,and puts forward some perfecting suggestions to solve these problems.In order to further improve the current criminal law regulation system on the raw material and mixture for drugs related behavior,need according to the revised criminal law,comprehensive to sort out the current judicial interpretation.Shall implement such items related to the improvement of the technical rules of behavior that with legalization,clarify the relationship between "raw material and mixture for drugs" and "precursor chemicals",the concept of extension,and in calculating the amount of the raw material and mixture for drugs will be accumulated and press purity hold;Specific regulation of criminal law on the behaviors associated with drug compound preparations containing precursor chemicals,have will not be in the form of drugs containing containing compound preparation of precursor chemicals drugs as "raw material and mixture for drugs" in criminal law;Add crime of illegal possession of raw material and mixture for drugs.
