A Study On Refugee Protection In International War Against Terrorism

The expanding International terroristic organization threatens the world order as terrorist force is growing stronger and stronger.At present,the world community and United Nations Security Council are taking positive steps to respond to the common enemy.However,launching anti-terror wars is the main choice of many countries.This method,to a great extent,will result in both good and negative impacts.And numbers of refugees will be produced during anti-terror war periods.The way to protect the rights of refugees and balance against the order and the human rights makes a great significance to the peace and development globally when we wipe out one of the factors leading to the rising number of refugees.In view of the current problems,this paper tries to find problem-solving approach from the perspective of human rights act,humanitarian law and laws of war.The paper is divided into five sections.Part one gives a basic description of “refugees' rights”,which consist mainly of definitions relating to refugees,basic principles on safeguarding them,and an introduction of the scope of refugees' rights in international law.Part two is on “External Environment Characteristics of anti-terror wars and how it affects refugees' rights”.First,this section gives a brief introduction of terrorism and inevitable features of such wars.Second,a series of external characteristics beyond such war regions will be presented as anti-terror wars have many characters.Third,it shows how such external environment characteristics influence refugee protection.Taking the negative impact as the start of the paper,the problems in respect of refugee protection will be analyzed as follows.Secondly,an introduction to the significant characteristics manifested through exterior environment caused by the properties of anti-terrorism war.In the end a manifestation was made on the changes the exterior characteristics bringing to the protection of refugees,following the aforesaid words are the challenges standing in the way of refugee's protection as we are making the improved polices to solve the problem.Part three analyses the problems in refugee protection from the perspectives of law,practices,and asylum-offering countries bearing huge pressure based on the negative impact on the displaced.And the research on regulations are conducted from unspecified refugees' definition,legal loopholes,conflicts on the principles,deviate from the principle,limitations of procedures,etc.As for the practices,the unavoidable impact and other objective problems of the legal institutions in nations and UN,as subjects of international law are analyzed.Asylum-offering countries play a huge role in protecting refugees,but they always suffer stressful atmosphere.Thus,to find the problems faced by such nations is the foundation for resolving conflicts.It is a must to conduct a research on the protection of refugees legally and practically.And the research on the system starts from the contradictory principles,the bugs in the law and the ambiguous definition for refugees.However,a research on the practice starts from challenges the anti-terrorism war meant to refugee protection and the terrorism.Furthermore,UNITED NATIONS HIGH COMMISSIONER FOR REFUGEES and the counties consist of the international law.As we can see,it is the only solution to the problem to analyze the current challenges in an objective view.Part four proposed how to solve the problems from the perspectives of international law,practices and extra-legal assisted methods.From the perspective of law,it is strongly recommended that provisions of safeguarding refugees' right should be added to main international treaties.Firstly,the suggestion was made that a safe and sound solution to the problem should be applied to deal with the contradictions between the anti-terrorism and refugee protection and then,making a better law system.Regarding the interior state in the country,all the countries over the world have to improve their law system.Practically,the countries' full role should be played in the anti-terrorism,making a better accountability initiative to supervise the exercising of anti-terrorism war.And then,remove the fly in the ointment for UNITED NATIONS HIGH COMMISSIONER FOR REFUGEES.Lastly,the further steps should be taken by international community to the protection of refugee.Besides,each country must establish a perfect legal system.As for the practices,coordinative protective mechanisms should be formed and accountability mechanism construction should be highlighted within each nation.Besides,extra-legal assisted methods will help protect refugees during the period of such wars provided that they are supervised.
