Study On The Thought And Practice Of Rule Of Law Of Socialist Core Values

The eighteenth national congress of the party put forward clearly the socialist core values based on three advocate and the make rule of law an important component of socialist core values,which is the inevitable choice of the development of the rule of law with Chinese characteristics and the inevitable requirement of building the rule of law in China.At the meeting,the Communist Party of China has put forward the new sixteen words principle of scientific legislation,strict law enforcement,fair justices,and all the people observing the law,which is the development and improvement of the original sixteen words principle,which is that there are laws to go by,the laws are observed and strictly enforced,and law-breakers prosecuted raised by of the third Plenary Session of the eleventh Central Committee.This shows that the rule of law in the theoretical and practice system of socialism system is greatly improved.The fourth Plenary Session of the eighteenth Central Committee of the party reaffirmed the importance of the ideas of scientific legislation,strict law enforcement,fair justices,and all the people abide by the law in ruling the country by law.The Party Central Committee regards these ideas as the basic pattern of the overall rule of law and make a more specific deployment,which show that the rule of law is the embodiment of the national governance system and governance capacity.The thesis consists of five parts.The first part is the definition of related concepts and the relationship between them.Through the interpretation of the concept of socialist core values and the rule of law,this paper discusses the status and role of the rule of law in the socialist core values from the perspective of the state,society and citizens.The second part introduces the development of the socialist core values.Through the analysis of the thought of rule of law since the founding of new China,this paper points out that the rule of law in China has gone through a process of development and perfection.The third part mainly elaborates the cultivation foundation of the legal thought of the socialist core values from the four dimensions of economic basis,political basis,cultural basis and social basis.It points out that the rule of law in China has rich soil and theoretical accumulation that make it grow and thrive.The fourth part discusses the main content of the thought of rule of law of the socialist core values,namely the thought of ruling the country by,the thought of scientific legislation,the thought of strict law enforcement,the thought of fair justices and the thought of universal observance of laws.These thoughts of rule of law provide theoretical support and system arrangement for comprehensively promoting the rule of law.The fifth part explores thepractical ways of legal thoughts of the socialist core values from the five aspects of strengthening the implementation of the constitution,insisting on prior legislation,strengthening law enforcement,regulating the judicial behavior and establishing the belief of the rule of law,and then achieve the goals of implementation the rule of the constitution,improving the quality of legislation,strictly administering by law,ensuring judicial justice,and promoting universal observance of laws.This measure can promote the construction of rule of law in China.Due to historical and practical reasons,there are still many deficiencies in legislation,law enforcement,justice and obeying the law,which need to be improved.The realization of the rule of law in China is a long process,therefore,it is necessary to solve properly the problems in the construction of rule of law in China.on this account,to create a fair and reasonable environment for China's legislation and law enforcement so that people are always bathed in a good atmosphere of the rule of law,breathing just oxygen.
