A Study On The Administrative License Setting Of Taxi Under The New Format

"Internet +" technology to promote the use of China's taxi industry has emerged in the traditional format and the new form of common development situation.In order to standardize the development of new forms of taxis,"Interim Measures for the Management of Tax Reserve Operators" was promulgated and implemented.The provisional approach was controversial after the release of the draft,the focus of the controversy is whether the network booking a taxi in accordance with the traditional taxis supervision mode,in particular,how to set the relevant licensing matters.According to the temporary approach,we can see that the license setting of the network reservation taxi is different from that of the traditional taxi: the franchise of the traditional taxi is still franchised,and the network reservation bus is subject to the ordinary license.With the help of Internet technology and the general licensing system,the development of the network reservation taxis has affected the traditional taxi industry.The root cause,because the taxi "two-track system" permission to set the two formats between the out of place,which to some extent hindered the integration of the old and new forms of development of the taxi.Under the new format,the "double track system" of taxi license in China has the characteristics of setting different basis and setting the scattered items.The problems existing in the license setting are mainly in four aspects: First,the traditional mode of taxi franchise exists and the second is that the administrative license of the network reservation bus violates the upper law.Fourth,the legal relationship between the new form and the traditional format is unclear.For the above problems,the author from the licensing set the subject,content,program three levels of analysis of its causes.In order to meet the needs of the new development of the taxi industry to promote the integration of old and new formats development,taxi license settings need to be further improved.We should first redefine the main body of the administrative license of the taxi,including clearly setting the subject,integrating the relevant legislation of the taxi,adjusting the direction of the taxi legislation;secondly,it is necessary to further clarify the value orientation of the administrative license setting of the taxi;Licensing matters,road transport permit matters,driver qualification matters in three aspects of the integrated optimization of taxi administrative licensing matters;Finally,the taxi license to set the administrative procedures,including the cost of the license before the set analysis,set the Public participation and post-evaluation feedback.
