A Study On The Registration Of Administrative Litigation In S Province

The new ? Administrative Litigation Law ? has been officially implemented on May 1,2015.The new law stipulates that the administrative litigation will be changed from the censorship system to the registration system.This provision will effectively alleviate the problem of "difficult of registration" in administrative litigation,Human administrative rights of prosecution will be safeguard,at the same time,more administrative disputes will also be into the court,with the original resources,the new system will inevitably have a certain degree of impact on the original working mechanism.In order to realize the legislative intention and ensure the smooth operation of the administrative litigation registration system,it is necessary to analyze the implementation situation of the system.This paper analyzes the number and type of cases in the first instance of the S administrative court before and after the implementation of the registration system,so as to find out the problems in the operation of the system and explore the reasons,then to make suggestions for improvementThe article is divided into four parts,the first part through the statistics,analysis the actual situation of received and closed cases of the provincial court from the year 2013 to year 2016,the changes in the number of cases of S province before and after the implementation of the registration system;the type and processing results of the administrative first instance cases.On the basis of the data analysis of the previous part,combined with the questionnaire survey data,found that the implementation of administrative litigation registration system in S province with the following problems: Firstly,Case more and people less contradictory intensified,secondly,the effective use of judicial resources is low,thirdly the environment of litigation registration system is not ideal;fourthly Non-v.Dispute resolution mechanism is not perfect.Thethird part is the analysis of the reason for the problem of the administrative litigation registration system in S province: First,the legislation is imperfect,and the second is the case divided and diverted system is not perfect,the third is the weakening of the filtering effect of the filing procedure,and the fourth is that the popularization of the system is not in place.The fourth part puts forward the suggestions :First,perfect the legislation,strengthen propaganda,guide people to rational litigation,the second is to make full use of mediation mechanism,the third is to improve the service on file,to achieve the case of diversion,improve the pre-court preparation procedures.
