Name is the symbol of citizenship,and name registration is an important way for the state to restrict the right of personal name moderately.How to balance the civil rights with the state power,so that the right of personal name should be guaranteed without losing the norm,is a major problem with name registration.The names of citizens have the social function of connecting society,the historical function of connecting family,and the moral function of connecting traditional culture.In nature,the right of personal name belongs to a kind of personality right.The right of personal name has not only personality attribute,but also identity attribute.So the right of personal name belongs to a special personality right.In modern times,citizens pay more and more attention to the right of personal name,and they believe that when the public security department register their names,the phenomenon of violating the right of personal name is very common,the real conflict between the right of personal name and name registration is gradually revealed through administrative litigation.Maintaining the balance between the right of personal name and the name registration by administrative department has become the focus of current exploration.At present,the name registration system of our country has the problems of legislative decentralization,low hierarchy of legal norms,simple content and inconsistent regulations.In terms of content,the contents of name registration are not connected with practice,the third surname stipulate is inconsistent in the law,the content of the name lacking the legal regulations,and the number of name changes has no concrete stipulate in the law.Therefore,it is proposed to establish a unified "The name Registration Ordinance" to improve initial name registration,and improve the relevant provisions on the changing conditions,the number of changes,and the prohibition of change in the registration of changes.With regard to the initial registration of names,it is suggested that the third surname should be properly liberalized,that the contents of the names should conform to the public order and good customs,and the used characters should be conformed to the contents specified in the General Chinese Character Specification Table.The length of the names can be limited to 3 to 4 words.With regard to the registration of name change,strict restrictions on change of name should be appropriately reduced,and the number of changes in names between minors and adults should be distinguished.With regard to prohibition of changing their names,certain restrictions may be imposed on citizens who have been subject to criminal or administrative penalties,and general provisions should be added to accommodate the new situation.
