Research On The Filing System Of Foreign Invested Enterprises

Our economy is growing,the number of foreign investment companies in our country is growing.These companies absorb large amounts of labor in employment,they also bring a lot of money and technology,all of this accelerated our economy's growth.In this case,our country continues to expand,improves the investment environment,and improves the legal system of our foreign investment enterprises.It is important to provide a better business environment for foreign investment firms and secure legitimate rights.2016,the Standing Committee of the National People's Congress passed the decision to change four laws of <Law of the People's Republic of China on Foreign-Capital Enterprises>,the approval items that do not involve the implementation of the provisions of the state on the administration of special administrative measures,to record management.The decision reduces the market access threshold for foreign investment enterprises,reduction of foreign investment access to administrative proceedings.It fully reflects the direction of China's government in the reduction of political decentralization,optimize the direction of service reform is conductive to improve the investment environment for foreign investment enterprises in China to continue to expand the development of facilities.However,there are some problems in the filing management system,for example,the system is not strict,the standard is not uniform,which has brought a lot of inconvenience to foreign investment enterprises.?Interim Measures for the administration of the record of the establishment and alteration of enterprises with Foreign investment?(here in after referred to as the Interim Measures),the third chapter provides a system of supervision and management of foreign-invested enterprises,but according to the legal responsibility of the fourth chapter,the supervision and management system of the third chapter can not really keep up with the foreign invested enterprises.In addition,China not has the introduction of related systems filing management authority delegated to agencies for the recordmanagement,will be devolved to which level of government departments has become a problem,the relevant departments timely introduction of appropriate regulations to guide the need.This paper is divided into four parts:The first part describes the overview of the registration of foreign invested enterprise system.The second part describes the implementation of the filing system of foreign invested enterprises,and analyzes the advantages of the filing system.The third part analysis the problems existing in the filing system of foreign invested enterprises.This part describes and analyzes the problems in the implementation process of the filing system through four aspects that set is not strict,filing standards are not uniform,lack of management authority delegated filing standards,Chinese natural persons can not invest in foreign investment companies and supervision can't keep up.The four part put forward the legal system of foreign investment enterprise filing system.According to the previous discussion,put forward bold ideas,trying to improve the filing of foreign-funded enterprises,clearly record the detailed rules for the implementation of decentralization of authority standard,allowing domestic China natural person become foreign investment enterprise investment subject,perfecting foreign enterprise supervision system,supervision of the four aspects to play its due role to solve the problem of the second part.
