Study On Urban Renewal Of Public-private Partnership

The sustained and rapid development of economy is the booster of the urbanization,but the chronic overload of the city also accelerates the decline of it.In the process,city usually can't keep up with social development and the basic living standard of the residents in the respect of environment protection and hardware facility,which has brought a series of social problems.And,it seems that this is the common problem of all the city around the world.“Urban renewal” comes into being under such background and makes its efforts for all the countries and districts in solving the problems of the decay of urban,ruin of environment,overload of population and public disorder.Every country has its different way towards urbanization and so does its problems and countermeasures,which leads to the difference in the model of urban renewal.Based on a unique concept,the Public-Private Partnership model in Taiwan has made great achievements,therefore,the research and analysis towards the model of Public-Private Partnership in Taiwan will benefits the improvement of the system and practice in the urban redevelopment(or urban renewal)in mainland China.The urban renewal system of Taiwan roughly experienced three periods: the government-dominated,the leading of private investment and the Public-Private Partnerships,all of which result in the formulation of the pattern of the Public-Private Partnership which based on the “Acts of Urban Renewal” and relevant regulations.Base on the analysis of relevant regulations and practices,the pattern of Public-Private Partnership can be divided into three stages: government's delineation,plan-making and execution.On the basis of introduction of the system and its process,this article induced the legislation idea,the usage of self-regulation administration,the embodiment of consultation and regulation system,and the design of incentive mechanism in this pattern.The heated discussion in academy circle of Taiwan on the “Judicial Review of Regulation No.709”(a Judicial Review of the Regulation by Justice)has not only an extraordinary significance and value for legislation and enforcement in the field of administrative law,but also in the perfection of administrative procedures.Focusing on “Wen Lin Yuan” crisis and “Judicial Review of Regulation No.709”,author in this paper has deeply explored the system and model of urban renewal of Taiwan.The last two parts of this article are concentrated on the discussion on the urban renewal in Taiwan,and analyzed the problems of the pattern of Public-Private Partnership,such as the insufficient of public interest,the lack of service procedures,the abuse of discretion of hearing,the lack of information disclosure and so on.And on this basis,the paper put forward some targeted proposals,and look forward to improve the urban renewal system and practice both in Taiwan and mainland China.
