Research On The Legal System Of Public Interests Of Urban Renewal

With the rapid development of our city, the shortage of public facilities and resources caused by the accumulation of population, environmental pollution and other issues influenced every individual in the city. Therefore, as a public authority, the City builders carried out the urban renewal activities, aiming to improve the city function, the optimization of human habitat environment and the integration of resources to ensure the sustainable development of city. There are several issues involved in the urban renewal. They are city planning, the launching of the project, decision-making system and compensation part. The corresponding problems, therefore, appear to be the legitimacy of city planning, difficulty in the concreter implementation and the lacking of supervision which leads to the demage of private interest. So, it is necessary to research on the study of public interest of urban renewal. With the analysis, comparison and refernce of how to enhance the legal system of urban renewal, it can be worked out the real value of urban renewal.After summing up the legal system of Chinese mainland and Taiwan area, it comes out that the question of public interest and controversy starts from the interests of the project itself, the justification and operation of the project and other stages of urban renewal. By studying the stages of launching and decision-making of the projects, the public interests of the legal system can be divided into several phases: the legitimacy of the power to decide the exact area of city renewal, the rationality of the threshold for the application, the necessity of the approval and appropriateness of the procedures set, and the rationality of vote ratio in the process of project operation.Finally, it turns out that in order to ensure the public interest of urban renewal, from the substantial aspect we should make sure the public use of the project and normalize the operation system by improving the legal system, and to strengthen the public participation and supervision in procedural aspect.
