Drug crime is a serious disease in China and the world,and its harm is not only in itself,but also the cause of other crime.The Opium War so that all the children of the Yellow Emperor poisoned by drugs.After the founding of new China,strict management of poison is the national fundamental policy.In recent years,the phenomenon of vulnerable groups involved in drug-related crimes is usually.After the use of these special circumstances,evasion of legal sanctions and harm to social phenomena has occurred,causing great trouble to law enforcement agencies.So that the penalties in the application of a lot of problems encountered,how to balance the legal and reasonable,to protect and care for the interests of vulnerable groups and to crack down on drug-related vulnerable groups.so that temper justice,deter crime,so that vulnerable groups in After the crime can be reformed,re-life,no longer drug-related,in order to achieve the purpose of prevention and reduction of drug crime.to do justice with mercy,deter crime,the vulnerable groups to start with a clean slate after the crime,a new life,no drug-related,in order to prevent and reduce the purpose of drug crimes.This is our country to crack down on vulnerable groups of drug-related crimes to solve the problem that is also the focus of this paper.The author combined with the sporadic provisions of the judicial interpretat ion and relevant conference minutes in recent years on the drug-related spillovers of the vulnerable groups,focusing on the analysis and thinking of several problems in the process of applying the penalt ies for drug crimes of each type of vulnerable groups.put forward on the basis of proposals.The thesis is divided into three chapters,combined with the "criminal law" and "Cr im inal Procedure Law" and the implementat ion of April 2016 "on the trial of drug crime case applicable legal interpretation" the relevant provisions of the first chapter of the drug crime includes juvenile group,elder ly group,women in pregnancy and lactation and seriously ill patients,disabled groups,the vulnerable groups in the personnel of drug-related crime were used to investigate the characteristics and causes of such drugs and drug-related crime trends..In the second chapter,based on the previous chapter,mainly discussed China's vulnerable groups of drug crime penalty situation and and points out the each kind of vulnerable groups.The problems of applying the problems in the judicial practice are analyzed separately.In the three chapter,according to the problems raised in the second chapter,the author puts forward some suggestions for the construction of the rule of law in China.
