| Along with the "Internet plus" era,constant improvement and development of people's living standards,the Internet has become an indispensable part of people's life.The Internet provides more convenient,but also some people carry out illegal activities inevitably through the network,such as network rumors and Internet Water Army frequently appear in our field of vision.It disrupts the harmonious network order.In recent years,the crime of intentionally spreading false and terrorist information has happened frequently in our country through various channels.Especially,the use of the criminal means of Internet becomes increasingly frequent,which seriously disrupt sour living environment and order,brings out unease and anxiety of citizens' spirit and the external environment,and endangers citizens' interests.Based on the case,the paper researches legal issues related to crime of intentionally spreading false and terrorist information in order to provide favorable reference in judicial cognizance and judicial practice of this crime.At the same time,the paper proposes some improvement opinions of relevant issues of the crime.The research contents and research emphases of this paper are as follows:The first part: explain the case so as to conclude the controversial points of the case.The second part: analyze the dispute focuses of the case,and determines the defendant.The third part: affirm relevant elements of the crime and research the crime and other similar crimes in comparison according to the latest judicial interpretation from deliberately spreading false and terrorist information the case causes.The fourth part: provide a reference of the current theoretical research combining with the case through the study of the domestic and foreign theoretical research status.The fifth part: based on the case analysis,draw the conclusion of this case,summarize imperfection of the legal provisions,and put forward some ideas and suggestions. |
